Photographers are both blessed and cursed when we encounter the work of fellow artists. By one measure, our visual acuity is refined and deep, having assimilated a vast aesthetic and historical lexicon of photographs throughout our lives – imagery that contextualizes new work we experience. But by another measure, this visual literacy interferes with our ability to observe new work on its terms with focus, curiosity, and naiveté. Instead of simple observation, we can easily be distracted by the technical.
Fortunately, Reuben Wu’s work manifests a visual sensitivity and finesse, which fuses with a refined aesthetic sensibility and technical mastery of his tools. Thus, we are freed to quietly be in the presence of each photograph appreciating it on its terms.
Wu’s work AE 1144, from the series, Aeroglyphs, places us in a different space than many of his other images. Instead of geometric light forms interacting with pristine, seemingly untouched natural landscapes, we encounter a scene that bears the unmistakable marks of human activity. The eerily glowing turquoise waters of the irregular canal, or ditch, are at once seductive and troubling. If we were to enter these waters, would they provide comfort and relaxation, or toxicity? Details along the water’s edge reveal information that, in theory, should help us discern scale, but these forms dissolve into a blackness where our ability to know what is geological or human-formed is masked. The twilight sky, with its panoply of colors and quiet drama, is inviting. Are we looking only at desert clouds or also the dissipating contrails of evening flights? While contemporary in the print’s vibrancy and hues, the surreal tones of water and sky, out-of-balance with how they would be seen in situ, evoke the mystery of Magritte.

Upon this scene, perhaps fully pre-visualized by the artist, but never experienced as a single moment, Wu scribes three central vertical parallel lines with the light of his drone. As with all light painting, these lines never exist in space to be seen by the naked eye. Instead, the open sensor, which replaces the sheet of film, collects the sum of his temporal activity. Thus, the landscape becomes a set or stage in which a performance occurs, but the results of this ephemeral series of events become apparent only in the finished image. While traditional land art leaves permanent or semi-permanent marks in the landscape, Wu’s art cannot be experienced except in the photograph.
Reuben Wu’s photographic vision – quiet, serene, contemplative, meditative, and formal – adds a valuable perspective to our collective photographic lexicon. Make the time to savor it.

Prosecution and defense lawyers delivered opening statements to the 12-member jury in federal court in Washington, painting dramatically different portraits of the 67-year-old Republican political operative who has been a friend and ally of Trump for four decades. Stone "straight up lied" to Congress, prosecutor Aaron Zelinsky told the jury, which was selected earlier in the day.
A key witness in the Donald Trump impeachment inquiry has reversed his evidence, indicating he did believe there was a quid pro quo in which US military aid would be denied to Ukraine unless it publicly launched a corruption investigation into Joe Biden. Gordon Sondland, the US ambassador to the European Union, had initially denied any knowledge of a link between the $391 million in aid and Mr Trump's request that Ukraine launch an inquiry into his political rival. But in a revised statement Mr Sondland said: "In the absence of any credible explanation for the suspension of aid, I presumed that the aid suspension had become linked to the proposed anti-corruption statement." Mr Sondland said that, after "refreshing my recollection," he remembered telling a senior Ukrainian official on September 1 that the aid would "likely" be stopped unless there was an investigation into Mr Biden and his son Hunter, who sat on the board of the Ukrainian energy company Burisma. He added: "I wouldn't say he hung up me, but it was almost like he hung up on me." The diplomat said on September 1 he discussed the matter with Andriy Yermak, an adviser to Mr Zelenskiy. Mr Sondland said: “I said that resumption of the US aid would likely not occur until Ukraine provided the public anti- corruption statement that we had been discussing for many weeks." Congressional Democrats also released testimony from Kurt Volker, the former US special envoy to Ukraine He said Mr Trump had told him to "talk to Rudy" - his personal lawyer Rudy Giuliani - about Ukraine matters. Mr Volker said the president told him: "They are all corrupt, they are all terrible people. I don't want to spend any time with that." Mr Trump has denied wrongdoing and accused Democrats of unfairly targeting him in hope of reversing his surprise victory in the 2016 presidential election. A White House spokeswoman said: "Ambassador Sondland said he 'presumed' there was a link to the [military] aid - but cannot identify any solid source for that assumption." She said there was "even less evidence for this illegitimate impeachment sham than previously thought."

The Field Medical Director, CAR T Lymphoma/CLL/MM US medical affairs, will be instrumental in supporting the execution and implementation of CAR T site medical strategy. I know everybody already knows about Trump getting booed at game five of the World Series last week, but I want to talk about it more because it was beautiful. Motherfucker got BOOED! Because everybody HATES! HIM! LOL. The DC home team, the Nationals, went on the win the World Series. I know baseball fans are notoriously superstitious so I can only assume that Nationals fans will now ceremoniously boo Trump ahead of every game from here on out. Forget your stupid popcorn and peanuts, this might be the tradition that gets me into baseball.

Twitter and Facebook have been locked in a terrible game to see which can do the most harm to our mental health and national conscience, but last week Twitter moved into the least-bad position. First, Facebook CEO Mark Zuckerberg testified before Congress about the harm Facebook unleashes on democracy and got his ass 100 percent handed all the way back to him by many members of Congress, including millennial socialist superstar Alexandria Ocasio-Cortez, who pretty much got Zuck to admit that he’s gonna keep cashing all the checks—misinformation and malice be damned. Meanwhile, Twitter CEO Jack Dorsey announced (in a tweet! Predictable.) that Twitter would not be running any political ads whatsoever anymore because they recognized it was too hard for users to differentiate between content they want and paid content that’s getting forcibly mashed into their brains. Twitter’s CFO went on to say “This decision was based on principle, not money.” Principles over money? On the internet? Sounds very fake news, but okay.
In another corner of the internet, principles lost handily to money: Gawker descendent sports-adjacent blog Deadspin was bought out by some tech bros a few months ago, who promptly missed the whole point of the site by demanding that writers “stick to sports” and then wantonly demolished staff morale to the point that every single writer and editor resigned en masse last week. Some of the best and smartest and silliest writers came from the Gawker universe; Deadspin was a holdout from a 2009-era internet that meant so much to so many of us, and it was destroyed because the jocks can’t stand that the nerds got cool. I really pity any writer who’s about to be looking for a job when so many of those extremely talented writers are pounding the same pavement! (This will be funny when you get to the end; keep going.)

Allow me to flex some elementary school-level math: Letâ€™s say each of those inspectors is making a low-ish starting wage for a government-adjacent employee of $45,000. Multiply that by nine and itâ€™s $405,000 for one year. TriMet could have bought full, unlimited passes for 12 whole months for 1,205 low-income residents instead of paying nine narcs to harass people of color and anyone who looks poor. Now I will make this about me: I live on one end of one bus route from my office, but itâ€™s somehow cheaper for me to gas, insure, and drive my Honda to and from work than it would be to take the bus, which Iâ€™d rather do. And if the city would prefer that I play my Sudoku while operating a motor vehicle rather than sitting on a bus, rubbing shoulders with friends I havenâ€™t met yet, that’s on them.
Did you know I’ve written this column for over one year and I’ve never once mentioned a Kardashian or Kanye? It’s true! I wanted to see if I could do it, and I can. A person can only yell about so many things with their time on earth, and plenty of people are already yelling about them, so I opted to focus my energy elsewhere. Not to suggest they’re not newsworthy, or that I don’t know what’s on their social media feeds most hours of most days, but some people are only firmly lodged in our national interest because we keep letting them stay there, and I wanted to make one little space that didn’t add to that. Yesterday, Sondland's memory miraculously recovered, with the ambassador releasing a four-page sworn statement that, as the New York Times summarizes, "directly contradicted his testimony to investigators last month."
Hours later, Portland Mayor Ted Wheeler announced he'd be returning roughly $16,000 that Sondland had donated to several of Wheeler's election campaigns.
"The Mayor made it clear that he wanted to give Ambassador Sondland the opportunity to explain his involvement in the Ukrainian scandal," Jennifer Arguinzoni, the manager for Wheeler's re-election campaign, said in a press release. "Especially in light of the acknowledgment of a quid pro quo and the testimony of Lt. Col. Alexander Vindman, it has become clear that Sondland's actions are potentially counter to the law."
As the Mercury's Alex Zielinski wrote two weeks ago, Sondland's influence over Portland politics has been evident for years. "Arguably Portland’s most powerful Republican, Sondland’s impact is everywhere: in Portland's swankiest galas, its most upscale hotels, its trendiest bars, and its politics," wrote Zielinski. "Campaign filings show that since 2010, Sondland and his associated LLCs have dumped a total of $16,500 into Mayor Ted Wheeler’s campaign fund. Sondland's wife and business partner, Katherine Durant, has added $6,500 to Wheeler's campaign coffers."
Sondland has given to others, too, including a total of $1,500 to City Commissioner Nick Fish (who told the Mercury he hasn’t spoken with Sondland since 2013) and $22,500 to the failed 2018 gubernatorial campaign of Knute Buehler.
"Wheeler is the first elected official of either party to announce a redirection of funds from Sondland," notes Wheeler Deputy Campaign Manager Amy Rathfelder.
The funds will be split among a number of beneficiaries, including Transition Projects, Basic Rights Oregon, Portland Parks Foundation, Portland United Against Hate, immigrant rights organization CAUSA, DePaul Treatment Centers, environmental advocacy group SOLVE, and Portland Audubon. The largest chunk of cash, $4,000, will go to "organizational partners of the grassroots ImpeachNow.org coalition," a coalition working to... well, impeach now.
While Wheeler has repeatedly and publicly clashed with Trump, he and his administration have been less transparent about his stance on Sondland's involvement in the impeachment scandal—possibly because, according to former Gov. Ted Kulongoski, it was at Sondland's urging that Kulongoski appointed then-county commissioner Wheeler as Oregon's state treasurer in 2010.
Others have been more forthcoming in their condemnation of Sondland. Following Sondland's initial testimony to impeachment inquiry investigators in October, Rep. Earl Blumenauer called for a boycott of Sondland's businesses in Portland. Even earlier in October, shortly after Sondland's role in the Ukraine scandal was revealed, Portland activist Sarah Iannarone—who's running against Wheeler in the 2020 election—called on Wheeler to return Sondland's donations. The next day, Wheeler spokesperson Timothy Becker told the Mercury that Sondland is "an integral part of our business community," adding, "The Mayor would hope and expect that Mr. Sondland would testify truthfully before Congress, when he is called to do so."

Right after Donald Trump lost the case against him for blocking people on Twitter, we noted that Dov Hikind, a critic of Rep. Alexandria Ocasio-Cortez launched a similar lawsuit against her for blocking him. Again -- because it's important to repeat -- the court rulings in the Trump case made it clear that politicians who used Twitter for part of their job representing the public could not block people, as that's a violation of the 1st Amendment. The specific criteria laid out by the courts were that (1) if you're a public official, and (2) using social media (3) for official purposes (4) to create a space of open dialogue, then you cannot block people from following you based on the views they express.
It appeared that the @AOC account met all of the criteria, and therefore should not be able to block critics for expressing their dislike of her stances or policies. Ocasio-Cortez, on her part, stood by her right to block people by claiming that she only blocked 20 people, none were constituents, and that they were only blocked for harassment which, she argued, was "not a viewpoint" (i.e., this wasn't viewpoint discrimination). Either way, just as the Hikind case was about to go to trial, Ocasio-Cortez has settled the case, admitted she was wrong to block Hikind and apologized:
The Knight 1st Amendment Institute, which had brought the lawsuit against Trump and had sent Ocasio-Cortez a letter arguing that she was incorrect to block people with her account, announced that they were happy with this result. According to their Senior Staff Attorney, Katie Fallow:
That said, while this case was settled and Ocasio-Cortez admitted to being wrong, she still seems to be standing by the idea that she can block some users:
There might be cases where it would not be a 1st Amendment violation to block users, but the details would matter quite a bit -- and the argument that harassment, by itself, would constitute a reason for blocking seems iffy, at best. Same with "exploit[ing]" her account "for commercial or other improper purposes." It will be interesting to see if other such cases are brought, or if the @AOC account choose to block others in the future.

Rep. Devin Nunes remains super angry about a satirical internet cow. Earlier this year, we wrote about his lawsuit against the satirical cow on Twitter (and against Twitter itself) as well as a bunch of other lawsuits Nunes has been filing against critics in the intervening months. The cases appear to be fairly obvious SLAPP lawsuits; that is lawsuits that are designed solely to silence critics, rather than based on any legitimate legal basis. As we've noted, the venues in which Nunes has focused his lawsuits (mostly Virginia, and now Iowa) have either weak or non-existent anti-SLAPP laws. Tragically, the original case, against two satirical Twitter accounts, including one called "Devin Nunes' Cow" (a satirical reference to Nunes' oft-repeated claim of being a California dairy farmer, even as his family farm has uprooted itself to Iowa) was not thrown out by the judge on jurisdictional grounds, allowing the case to move forward.
According to the Fresno Bee, however, even as that lawsuit is ongoing, Nunes' lawyer in the case has sent a threatening demand letter to Andrew Janz, a lawyer and state prosecutor who ran against Nunes in the last election and lost (much more narrowly than many people seemed to expect). The full letter is truly a piece of work, demanding Janz make the @DevinCow account stop making fun of Devin Nunes and issue an apology.
I only wish I was joking. The letter is amazing in so many ways, starting from the opening lines:
A matter of grave import and enormous consequence?!? Do tell! Oh, it's the fact that a thin-skinned public official can't take pretty modest mockery:
I mean, how could anyone think this letter was a good idea?
The letter then notes that a PAC connected to Janz appeared to be helping to raise legal defense funds for whoever is behind the @DevinCow account. If true, that wouldn't violate any laws, but Nunes and his lawyer imply that something terrible is happening here.
Malicious harassment, cyberbullying, stalking and defamation? Get over yourself Nunes. What happened to supporting free speech and the 1st Amendment? A satirical cow mocking you is none of the above. It is not harassment. It is not cyberbullying. It is not stalking. And it is most definitely not defamation. It's satire. It's the mocking of public officials, which is something we've celebrated in this country basically since the very beginning. It's also all entirely protected by the First Amendment of the Constitution. You know? The document that Devin Nunes has sworn to protect?
Now come the demands to Janz. Because he's apparently helping to organize the legal funding to protect whoever is behind the @DevinCow account from this obvious SLAPP suit, Nunes' lawyer is now making patently ridiculous demands:

This is all, of course, utter nonsense. And this is all strategically bizarre. Who could possibly think that getting this freaked out by a satirical account could ever possibly lead to anything good? It appears to show Devin Nunes is scared of fairly mild criticism and mockery. And the idea that such a ridiculous letter would have any good results, other than leading to even more mockery of Nunes for his thin-skinned freak out, and raising serious questions about Nunes' own fitness for office. If you can't take a bit of criticism from satirical constituents, maybe you don't belong in public office.
Also, even if this is all performative, all it's really served to do is get a lot more people paying attention to the satirical cow. Before the lawsuit, the account had about 1,200 followers. It now has over 630k -- which is pretty close to Nunes himself (there was a point in which the cow surpassed Nunes himself, but both have increased their follower counts quite a bit since then. Either way, encouraging over 600,000 users to follow an account designed solely to make fun of you, and then continuing to throw a legal temper tantrum over the account is not a good look for a sitting Congress member.
In the meantime, it certainly doesn't look like the DevinCow account has any interest in backing down or apologizing:
In the meantime, Nunes continues to be wrong about Twitter as well. In a recent interview he spouted a bunch of nonsense about the case:
He claims he had no choice but to sue. That's wrong. He could have not sued, for instance. He could have ignored the mockery. Or he could have responded to it. He could have shown why they were wrong if they were. There are many options short of suing -- especially for a Congressman who once introduced a bill to stop frivolous lawsuits. He says he's "been slandered and defamed" which is also just wrong. Slander is spoken defamation. If there was defamation (and there wasn't) it would be libel, not slander. But even more to the point, he's arguing that Twitter is negligent and that's why he's suing Twitter as well. Why negligent? Because something something bots. No, really.
First off, even if that's true, so what? How is that "negligence"? How is that against the law? The interviewer even seems a bit surprised by this and asks if there "evidence to that effect" and Nunes doesn't actually say that there's evidence, but seems to suggest that Twitter protecting the anonymity (a 1st Amendment right, by the way) of its users is proof of negligence.
Spoiler alert: what Twitter and their high-priced lawyers have been doing over the last six months is certainly not negligence. Protecting the 1st Amendment protected anonymity of your users, who include some satirical accounts mocking a thin-skinned Congressman, seems like good practice in protecting free speech and the all-American tradition of being able to speak up and criticize our elected officials.

Secondo lo studio, il 38% delle città che hanno implementato soluzioni di mobilità intelligente, hanno avuto un riscontro positivo dagli utenti e nel 32% delle città, grazie ai miglioramenti nei tempi e nelle modalità di consegna delle merci, sono migliorati i tempi di produttività per le imprese. Mississippi voters headed to the polls starting at 7 a.m. Tuesday to vote for top State and regional offices, including the election for governor. Polls will remain open until 7 p.m., when election workers will begin tallying up the vote. Mississippians must bring a State-approved form of photo ID to vote, such as a driver's license or student ID.
More information on voter ID is available on the secretary of state's website. A sample ballot for Hinds County voters is available here.
The secretary of state's office spent much of the morning correcting misinformation. Some voters received letters from an organization called the Center for Voter Information, which gave "neighborhoods a 'grade' based upon voters' alleged previous vote history according to party affiliation."
Mississippi does not register by party, though.
"Correspondence like this is intimidating and misleading and ultimately deters voters from going to the polls to cast a ballot," Secretary of State Delbert Hosemann, who is running as the Republican nominee for lieutenant governor, said in a statement Tuesday morning.
Also on Tuesday morning, the Hinds County Facebook page initially sent out a message encouraging voters to "VOTE IN THE MISSISSIPPI GENERAL ELECTION TODAY, NOVEMBER 11TH." That message was up for over an hour before Hinds County replaced it with today's correct date: Nov. 5.
The cover of the current Jackson Free Press also gave the wrong election date due to a typo no one caught before the issue went to print. We have sent out notices in social media correcting the error. A small graphic on the cover said, "Vote on Tuesday, November 8," rather than Nov. 5, although a full-page add on page 5 listed the correct date. We apologize for missing the mistake.
Last-Minute Endorsements, Last-Minute Fearmongering
In the Mississippi governor's race, Republicans last night began circulating a recording of a robocall former President Barack Obama made, urging Democrats to vote for their nominee, Jim Hood, even as others claimed on social media that it was fake.
"At the 11th hour Jim Hood had Barack Obama endorse him for Governor of Mississippi," current Republican Gov. Phil Bryant tweeted Monday night. "Now we finally know what he really believes. Vote Republican tomorrow and end this once and for all."
While Bryant and other Republicans sought to portray the Obama endorsement as a scandal, they have openly touted President Donald J. Trump's support for Reeves—despite the fact that Trump is facing an impeachment inquiry, is implicated in multiple federal and state criminal investigations, and that numerous of his former aides from his time on the campaign trail and in the White House are under investigation, in prison, or awaiting sentencing.
Democratic sources confirmed to Jackson Free Press editor Donna Ladd last night that the robocall was real. On Tuesday morning, Barack Obama Communications Director Katie Hill also confirmed to the Jackson Free Press that the voice on the robocall is indeed the former president's.
Going after Democrats by emphasizing their ties to people of color is not a new tactic in Mississippi politics—or in this election. During both his Republican primary against Republican opponent Bill Waller and the general election against Hood, Reeves sent out mailers showing his opponents near images of national figures like U.S. House Rep. Alexandria Ocasio-Cortez, D-N.Y., and U.S. House Rep. Ilhan Omar, D-Minn.
During Reeves' first race for Mississippi treasurer in 2003, Democrats accused the GOP of helping him beat a more qualified opponent by sending mailers out to white voters that included a photo of the Democratic candidate, Gary Anderson, who is African American.
On Tuesday morning, Democratic presidential candidate Kamala Harris tweeted out a last-minute endorsement for Democratic nominee for Mississippi Attorney General Jennifer Riley Collins.
"@JenniferforAG is a proven public servant and civil rights lawyer; she has the lived experience Mississippi families desperately need to move the state forward. Mississippians, you have a chance to make history today," Harris tweeted.
Concerns About Jim Crow-Era Election System
If she won, Collins would be not only the first African American elected to statewide office since the late 1800s, but the first African American woman ever elected to a statewide office in Mississippi.
Mississippi's Jim Crow-era election system for statewide offices could prove troublesome for Democrats, though. Under it, Democrats must win not only a majority of the vote, but a majority of Mississippi House Districts. If they do not, the GOP-dominated Mississippi House would select the next governor.
A federal judge declined to block the law ahead of the election. While some polls show Hood with a narrow lead over Reeves in the governor's race, plaintiffs in that court case told the judge that a Democratic candidate might have to win 55% of the vote in order to win the election under the current system because of the way House districts are distributed.
When Mississippi first adopted the 1890 Constitution that implemented this system, one of its framers, then House Rep. James K. Vardamn, explicitly said that the purpose of the new constitution was to curtail black voting power.
"There is no use to equivocate or lie about the matter. Mississippi's constitutional convention was held for no other purpose than to eliminate the n——r from politics; not the ignorant—but the n-——," admitted Vardaman, who later became governor and then a U.S. senator.
That provision last came into play in 1999, when Democrat Ronnie Musgrove won a majority of votes but not a majority of House districts. The Democratic majority House voted to make him governor. If a Democrat in a statewide race but not a majority of House districts, that could potentially throw the issue back to the federal courts, who would then have to decide whether or not the system is constitutional.
Aside from Collins, Democrats are running three other African Americans at the top of statewide tickets, with former Hattiesburg Mayor Johnny DuPree running for secretary of state; former Bolton, Miss., Alderwoman Addie Lee Green running for treasurer; and businessman Robert Amos running for insurance commissioner.
In the race for governor, Hood is holding an election night watch party in Jackson at The King Edward Hotel's 2nd floor ballroom at 235 W. Capitol St. starting at 7 p.m.
The Mississippi Republican Party is holding an election-night watch party for Reeves and all other GOP statewide candidates beginning at 7:30 p.m. in Jackson at The Westin Hotel on 407 South Congress St.

Recently, I’ve been pursuing instances of “hope,” which, one would think, are usual and non-rare. But if you pay even marginal attention to media, politics, arts and, yes, religion, you may have noticed the near disappearance or, one hopes, merely the eclipse of “hope” in our culture of prevalent hopelessness.
Where do we hear or sense the presence of hope in displays or discourse or common activities? Our calling is to track a subject like this in religion, where one might least expect the decline of “hope.”
Following the Apostle Paul’s First Letter to the Corinthians, Christian texts locate “hope” with “faith” and “love” as the three “abiding” phenomena which attract and measure all adherents. Compare the texts of various religions: Begin with Judaism, as notable rabbi Jonathan Sacks writes about “How the Jews Invented Hope” in his book Future Tense: Jews, Judaism, and Israel in the Twenty-first Century. Those who read it will learn what is distinctive in Judaism’s understandings of hope.
Similarly, the Quran is rich in dealing with hope, in realistic contexts, as the article “Hope and Despair in the Qur’an,” on the popular website Why Islam?, suggests. And one can find similar-yet-distinct instances of “hopeful” thought in Buddhism as well as in other religions and faith communities around the globe.
Accent on “hope” is most emphatic in times and places where it is most needed, sought after and welcomed: in times of droughts, wars, economic or political stress, to name a few. Needless to say, the presence or absence of talented prophets, poets, philosophers and theologians also plays a major role.
In Protestantism, the most concentrated attention to what was called “hope theology” in previous decades and a “theology of hope” more recently appeared in cultures whose Christian faith was sourced beyond old Christendom in the middle of the 20th century, which occurred predominantly in Europe and the U.S. When the World Council of Churches was young, its Second Assembly — which met in Evanston, Illinois, in 1954 — was devoted to “Christ the Hope of the World,” as societies and cultures were dealing with the memory and very real experience of hopelessness in the aftermath of World War II.
Not long after the Assembly, Jürgen Moltmann published the best-known individual work on the subject — his Theology of Hope. The German professor soon had company, in his fellow countryman Wolfhart Pannenberg and the American superstar Harvey Cox, who saw fresh hope in the secular order. Should there in fact be a recovery of “theologies of hope” — for which some hope again — it will likely be the case that Moltmann and related texts will be revisited and their themes updated.
What is abundantly clear from those texts is that this hope had little to nothing to do with “optimism,” though there was plenty of that going around in those years. (Doggerel helped spell the difference: “The optimist fell ten stories. As he passed each window bar, he shouted in to his comrades, ‘It’s all right so far.’”) Instead, in the episode in which the “theology of hope” prospered, the accent was not on the immediate or, for that matter, on the longer past, but, instead, on the future.
Those who profess hope and act upon it are aware that they cannot count on the same cultural support by majorities or large minorities that they could in decades past. But most do not spend their time indulging in nostalgia for “the good old days” or in cultural regression. They want to resurrect hope in word and action, in a world of nihilism, chaos and passivism.
The most quoted biblical passage on this theme by the “hoping” theologians was and remains Jeremiah 29:11: “For I know the plans I have for you, declares the Lord, plans for welfare and not for evil, to give you a future and a hope.”
It shouldn’t be a surprise that this theology is heavy on eschatology, a vision of the “end” when suffering has been overcome. Yet we past-minded historians had to relearn to rely on the promises of God to act in the future. “Hopers” in many faiths draw on significant precedents in their respective traditions to cultivate hope among their faithful, and for the “hope” theologians in Christianity, the accent on the future has led them to make much of Jesus Christ, the “resurrected one.”
Seifert offered that “the human, moral, and ideological destructive forces at work in the European Union — aimed at constructing what some have called a ‘false Europe,’” were developing an “empty façade of European peace and happiness,’’ and that “cheap and superficial ideologies” were replacing true hope.
He quoted philosopher Gabriel Marcel: “Hope (is) the stuff of which the soul of Europe is made.”
"Shocked. Shocked!“ is a popular meme for when something is not shocking. The popular film Casablanca (1942) featured actor Claude Rains as Captain Louis Renault, who was forced by the Nazis to close down Rick’s cafe (where he had been gambling). Rick asked him why it was being shut down:
Renault: Everybody is to leave here immediately! This cafe is closed until further notice. Clear the room, at once!
Rick: How can you close me up? On what grounds?
Renault: I am shocked- shocked- to find that gambling is going on in here!
Croupier: [hands Renault money] Your winnings, sir.

The “shocked, shocked” expression began to be used in popular culture in the 1970s and 1980s. It was printed in the Boston (MA) Evening Globe in 1971 and the New York (NY) Times in 1974. “Shocked, shocked” has been used in politics, such as after finding that a politician is corrupt.

Amid the uproar over Indiana’s new Religious Freedom Restoration Act (RFRA), its supporters declare that they never anticipated the critical outcry that has greeted the law’s passage. In statements that echo the incredulity of the French prefect of police in the movie Casablanca, they have professed themselves shocked to discover that anyone could object to the idea of giving religious believers added protection from an overbearing government that is apparently dangerously oppressive and hostile to religious practitioners.

About a year and a half ago, U.S. Senator Tammy Baldwin (D-WI) introduced a bill which would cut down on ACA premiums considerably for younger enrollees by beefing up the subsidy formula for the so-called "Young Invincible" population: Adults between 18 - 34 years old. Last week, she re-introduced the bill along with U.S. Representative Don McEachin (D-VA).
While the bill, titled the "Advancing Youth Enrollment Act", wouldn't have nearly as much impact on premiums or enrollment as the more expansive ACA 2.0 bills I've been promoting (H.R. 1868 & 1884 in the House; S.1213 in the Senate), anything which reduces premiums for more people without reducing patient protections or coverage standards is always a good thing in my book, so I'm happy to give Baldwin's bill another shout-out:
Remember, under the ACA, subsidies for enrollees earning 100-400% of the Federal Poverty Line (FPL) are based on comparing the unsubsidized monthly premium for the benchmark Silver plan against their household income. If the benchmark premium is higher than a certain percent of their income, anything over that income threshold is the amount of their subsidy.
As a simple example, let's suppose the benchmark premium for a single 30-year old is $600/month. That's $7,200/year. Let's further say that they earn $30,000/year, or 240% FPL.
$7,200/year is 24% of their income. Based on the current ACA subsidy formula, at 240% FPL, they're limited to around 7.93% of their income having to be paid, or $2,379/year. Right now, this young adult would pay $198/month for a Silver plan after receiving $402/month in subsidies.
Under Baldwin's proposed bill, a 30-year old would have thier premium cap reduced by 2.5 percentage points, to 5.43% of income. That's just $1,69/year or $136/month, boosting their subsidies by $62/month. From 31 - 34 years old that 2.5 point reduction would drop off a half a point at a time, like so:
There's a bit more to it than this--It's my understanding that the reduction would also apply to the rest of the household to some degree in cases where there are older members as well--but you get the idea.
The other benefit, of course, besides reducing costs for younger enrollees, is that this would draw in more sorely-needed "Young Invincible" enrollees into the ACA individual market risk pool, improving it substantially and thus reducing the unsubsidized premium levels accordingly as well. This, in turn, would also reduce premiums for unsubsidized enrollees while simultaneously also reducing the amount of subsidies which need to be paid out.
In other words, while this reduction might appear to cost, say, another $5 billion per year in federal spending, the ripple effect on the risk pool would drop that down significantly to, say, $3 billion/year or whatever.
Anyway, this bill obviously has zero chance of passing the Senate as long as Mitch McConnell is the Senate Majority Leader, but it's a great idea whether combined with the more robust ACA 2.0 bills or not, so I fully endorse it.

Like Jack Twist in Brokeback Mountain, I can't seem to quit playing around with the jaw-dropping possibilities which could impact future Medical Loss Ratio rebate payments in response to the ghosts of Open Enrollment Periods past.
Back in June, I reported that the Supreme Court of the United States had agreed to take up the long-simmering (4 years!) Risk Corridor Massacre class action lawsuit:
Again, here's the short version:
In the middle of the very first Open Enrollment Period, however, Congressional Republicans insisted that the rules of the Risk Corridor program be changed in such a way that if there was a shortfall in the fund, the "losing" insurance carriers would have to eat their losses no matter what...which is exactly what happened to the tune of over $12 billion over the course of 2014, 2015 & 2016.
Along with some other factors, led to financial ruin for nearly 20 smaller startup carriers, most of which didn't have the cash reserves to help them weather the Risk Corridor storm. I wrote obituary blog entries for yet another victim of the Risk Corridor Massacre weekly between August and November 2015...in a few cases, two of them went bankrupt the same day.
OK, so if SCOTUS rules in favor of the carriers (and they absolutely should...regardless of what you think of health insurance companies, the fact remains that they are contractually owed this money by the U.S. Government), most of the carriers will get paid what they were originally owed, and whatever firms now own the assets of the carriers which went belly-up will finally get a return on their investment. Big deal for the rest of us, right?
Well, yes...except that there's more to the story, and it involves, once again, the beauty which is the ACA's Medical Loss Ratio rule.
Again, under the Affordable Care ACt, insurance carriers on the individual market are required to spend at least 80 of their premium revenue on actual medical claims. If they spend less than 80% over a rolling three-year period average, they have to pay back the difference to the policyholders.
I wrote about this extensively in my big MLR Rebate Project a few months ago, which analyzed not only the record-breaking actual 2018 MLR payments ($770 million nationally) which went out in September, but also made projections as to the potential 2019 MLR rebates which will go out a year from now. My conclusion was that the 2019 payments (going out in 2020) could end up being double this years' due to the overpricing for the 2017 & 2018 plan years being fully baked in (potentially up to $1.7 billion total).
I then noted that due to the judgments in a different federal class action lawsuit regarding CSR reimbursement payments (not to be confused with the Risk Corridor payment case), 2020 MLR rebates could potentially be as much as quadruple this years...potentially hitting over $3 billion.
Aside from details on the timing of the SCOTUS arguments and decision, Young's article is mostly a more detailed overview of the history of Risk Corridors, how they were changed, how it impacted the carriers and how the lawsuit is playing out. She also, however, includes two important footnotes...especially the second one:
In other words, having an "extra" $100 million (or whatever) counted as 2020 revenue would cause the carrier's 2020 MLR to drop several points, so they're more likely to lower their 2021 premiums to boost that years' MLR back up a few points to cancel it out for the 3-year rolling average formula.
However...that won't change anything for the payments going out in 2021, which would include the averages from 2018, 2019 and 2020.
I think you can see where I'm going with this: If the Supreme Court rules in favor of the plaintiffs, and if they order the federal government to pay out the years-past-due Risk Corridor funds, and if the money has to be counted as part of their 2020 revenue, that will likely mean a whopping $12 billion windfall being dumped into the laps of several hundred insurance carriers around the country all in one shot.
If all of that happens, then any carrier which is hovering around the 80% threshold (or already below it) would have to pay out a large chunk of it...or potentially even all of it...back to the policyholders.
Again, none of this is guaranteed. SCOTUS might shoot down the lawsuit, in which case nothing changes. They might rule for the plaintiffs but include some unusual rules about how the risk corridor payments are made or accounted for. Who knows?
OK, let's take another look at the amounts actually owed to the carriers. Around $1.3 billion of it is owed to the small group market, which isn't really relevant here...I mean yes, it's a lot of money, and yes, this could mean some small bonuses to employees of small businesses, but the small group MLR rebates hasn't been nearly as volatile as the individual market over the past six years, so it's the individual market column you should be focusing on:
I've bold-faced the five highest dollar amounts. For the individual market it's BCBS Texas; BCBS Illinois; BCBS North Carolina; Highmark (Pennsylvania); and Humana (Georgia)
I noted earlier that a good twenty or so carriers have actually gone bankrupt...including Health Republic of NY. I assume their risk corridor payment would go to pay back the creditors. A few others have merged with or been acquired by other carriers; I have no idea how that will be handled.
Not only is Blue Cross Blue Shield of Texas owed more risk corridor money than any other carrier, it's not even close--they're owed over $1 billion, nearly twice as much as BCBS Illinois ($571 million). Nearly all of that consists of the $982 million BCBSTX is owed for their Individual Market business.
I don't know how many Indy market enrollees BCBSTX will have in 2020, but as of last year I have that number down as 390,000 Texans.
This resulted in a 3-year average of 77.2%. They had to pay out $75 million to 382,000 enrollees, averaging $196 apiece.
For 2019, BCBSTX reduced their average premiums by 6.5%. Assuming identical enrollment and a 5% medical trend for the year, I'm projecting (very roughly) perhaps $1.88 billion in claims against $2.50 billion in revenue. If so, that'd mean a 75.2% MLR for 2019...which in turn would mean a 71.4% 3-yr MLR. BCBSTX would have to pay back over $216 million to their policyholders, averaging $566 apiece.
For 2020, BCBSTX is reducing rates another 2.0%. Let's assume identical enrollment and a further 5% medical trend. If so, that would mean $1.97 billion in claims on $2.45 billion in revenue, pushing them back up to 80.6% MLR. The 3-year rolling average for 2020 would be around 73.9%...they'd have to pay back $149 million in 2021.
Now what happens if you drop an additional $983 million on top of their 2020 revenue?
Suddenly their 2020 MLR plummets to just 57.4%. The three-year average for 2020 is now just 65.5%...they'd have to pay back (wait for it)...$498 million in 2021 alone.
Divided among around 380,000 enrollees, that would average around $1,300 apiece. Furthermore, that's only one year...that 57.4% MLR will be factored into the equation for 2021 and 2022 as well.
But wait, there's more!
It's important to note that even if everything plays out this way, it doesn't mean that all $12 billion will be paid out. For one thing, the individual market portion is only $10.9 billion of the total; the odds are a far smaller portion of the other $1.3 billion on the small group market would end up being paid out no matter what. For another, even this year (with record-breaking MLR rebates), of the 2,700 total carriers nationally, only 207 had to pay out any MLR rebates in any market, and only 67 owed MLR rebates on the individual market. That's still 3.7 million people who received rebates this year (even if some checks were only for $20 or so), however.
...or SCOTUS could shoot down the case entirely.
The possibilities are endless.

Back in late June, right after the first Democratic Primary Candidate Presidential Debate, I posted an analysis & table to break out exactly where each of the then-20 (!) candidates stood when it comes to the Next Big Thing in U.S. healthcare policy. I posted a couple of updates as the summer and early fall progressed.
At the time, my main point was that regardless of their official campaign rhetoric, the truth was that nearly all of the candidates were open to multiple paths towards expanding healthcare coverage...both in terms of the number of people covered, the scope of that coverage and the cost of coverage to the enrollees, with a greater portion of the total cost being borne by the federal government.
This, of course, is a vast contrast to what the Trump Administration and Congressional Republicans have been pushing for, which amounts to the exact opposite: Fewer people being covered, by less comprehensive care, with fewer protections, and with less (or ideally none) of the costs being borne by the federal (or state) government.
It's now early November, a few more have dropped out, and while there's still officially over a dozen candidates running, the likely field has now been narrowed (in my view) down to six:
I suppose you could also throw in Sen. Cory Booker and former HUD Secretary Julian Castro if you were really pushing it, and if either of them has an amazing last-minute comeback I'll be happy to update this post again (I like both of them). And no, I'm not including Tulsi Gabbard, Andrew Yang or Tom Steyer. Again, if one of them manages to surge, fine; I'll eat crow and deal with it at that time.
With this in mind, I've decided to repost a "clean" version of this analysis instead of adding another messy update to the old one, so here goes:
With all the fuss & bother being made over whether Democratic Presidential candidates support or don't support eliminating private insurance in favor of a universal, fully-mandatory "Medicare for All" single-payer healthcare system, I decided to attempt to put together a comprehensive table listing which healthcare expansion/overhaul bills each of the candidates actually support or oppose.
This may sound like a simple question: Senators Sanders (obviously), Warren and Harris are all cosponsors of Bernie Sanders' "Medicare for All" bill, S.1129, right?
Well, it's more complicated than that. Most of the Senators (and some of the House members) running have actually cosponsored other significant healthcare expansion bills as well as "pure" Medicare for All...and many have made public statements indicating that they'd likely also be open to some of the other bills on the table (or some variant thereof). Harris has formally split from her prior support of Bernie's bill and is now proposing a hybrid variant which would allow for a "Private Option" in the form of beefed-up Medicare Advantage plans with much tighter regulations (similar to my preferred bill, "Medicare for America")...but she still calls her plan "Medicare for All", confusing the issue further.
Meanwhile, Biden & Buttigieg can't officially "cosponsor" any bills since they aren't in the House or Senate, so I had to go with their official plans as laid out on their campaign websites. Klobuchar has cosponsored several bills; her campaign site doesn't specify any one particular bill but the description of it is very similar to several of them as well as being similar to Biden & Buttigieg's proposals.
Since my earlier version of this analysis, I've simplified not only the list of candidates but also the types of plans--I've cut them down from eight specific bills/plans on the table down to four types of plans, each of which may include more than one specific bill. I've done my best to clarify which candidates either officially support, officially oppose or are open to supporting each. I've also thrown in my own preferred route forward for the heck of it.
There are technically fourteen different specific bills referenced, although in several cases they're basically just the House and Senate versions of essentially the same bill. These break out into four main categories:
ACA 2.0 with a Public Option:
Universal Coverage WITH a Private Option:
Universal Coverage with NO Private Option:

My larger point is that all of the bills listed below are good, and they'd all represent a significant improvement to existing law.
The irony of this is that WHATEVER the Big Healthcare Overhaul Bill ends up being (and remember, all of this assumes a blue trifecta, with Democrats retaking the White House and Senate while retaining control of the House), it’s NOT going to end up looking exactly like ANY of the current plans on the table anyway.
Again, I may be a strong proponent of Medicare for America, but I still recognize that even if that becomes the basis for the final bill, there would no doubt be some changes made before it gets passed by the House, Senate and signed into law by whichever candidate below ends up winning...and that's fine.
Meanwhile, here's Donald Trump's "healthcare plan":
(Yes, technically speaking, the House GOP's "Republican Study Committee" recently came out with their own "replacement plan" for the ACA if it's struck down...but it's basically just the same warmed-over glop they tried to push a couple of years ago in the form of the "Graham-Cassidy" bill, which amounts to a mish-mash of terrible ideas like "block grants", "high risk pools" and the like. Otherwise, that's it.)

Attorney General William Barr reportedly declined a request by President Donald Trump to hold a press conference defending Trump's incendiary call with Ukrainian President Volodymyr Zelensky which spurred the House to open up an impeachment inquiry.
The call was the subject of an anonymous whistleblower complaint filed in August that accused Trump of "using the power of his office to solicit interference from a foreign country in the 2020 US election," in particular, asking Ukraine to investigate former Vice President Joe Biden and his son Hunter Biden to aid Trump politically.
When the memo of the call was released, a Justice Department spokeswoman told The Post that officials had investigated the call, along with the whistleblower complaint, to see if laws had been broken and determined that "no further action was warranted."
During that time, the request from Trump that Barr hold a press conference on the matter was relayed to other White House officials before making its way to the Justice Department, according to The Post, though Barr ultimately declined the request from his boss. It is unclear how the request was delivered and why Barr declined.
Trump advisers told The Post that Trump has recently mentioned Barr's refusal to make a televised statement on the matter and wishes he would have done so.
Despite their differences in opinion, White House spokesman Hogan Gidley told The Post that Trump and Barr remain on good terms: "The President has nothing but respect for AG Barr and greatly appreciates the work he's done on behalf of the country — and no amount of shady sources with clear intent to divide, smear, and slander will change that."
The White House did not immediately respond to a request for comment.
In the days leading up to the July 25 call, Trump ordered his administration to withhold nearly $400 million in military aid to Ukraine. Among other things, House investigators are working to determine whether there was quid pro quo arrangement, in which Trump would release the aid money to Ukraine in exchange for political investigations.
The White House has vowed it will not to cooperate with the impeachment inquiry, which was formalized last week with a vote in the House. Over a dozen witnesses have been interviewed in the inquiry so far.
Trump maintains that the call was "perfect" and has tweeted that people should "read the transcript," referring to the summary of the call. Last week, Trump told conservative outlet the Washington Examiner that he wanted to read aloud the summary of his call during a "fireside chat on live television."
"This is over a phone call that is a good call," Trump told the outlet. "At some point, I'm going to sit down, perhaps as a fireside chat on live television, and I will read the transcript of the call, because people have to hear it. When you read it, it's a straight call."

Republican Sen. Lindsey Graham continues to find novel ways of defending President Donald Trump as the impeachment inquiry ramps up.
Graham's latest defense of Trump is that his policy toward Ukraine is so "incoherent" that he's "incapable" of orchestrating a quid pro quo in his relations with the country.
"What I can tell you about the Trump policy toward Ukraine: It was incoherent. It depends on who you talk to; they seem to be incapable of forming a quid pro quo," Graham told reporters on Wednesday.
The South Carolina senator on Tuesday said he refused to read transcripts from the testimony of current and former diplomats that were released by House investigators.
One of the diplomats — US Ambassador to the European Union Gordon Sondland — in revised testimony corroborated the existence of an explicit quid pro quo involving frozen US military aid to Ukraine and Trump's desire for certain investigations, including an inquiry into former Vice President Joe Biden.
Graham on Tuesday dismissed Sondland's reversal, telling a CBS News reporter: "I've written this whole process off ... I think this is a bunch of BS."
The senator had previously said there was no evidence of a quid pro quo involving the president.
On Wednesday, Graham continued to criticize the impeachment-inquiry process, which is being led by House Democrats, as he offered his new defense of Trump.
"I find the whole process to be a sham, and I'm not going to legitimize it," Graham said on Wednesday, going on to call the whole process a "crock."
Graham added: "This whole theory of impeachment, the process is illegitimate, is outside the norm, this substance I find unpersuasive."
The Republican senator, who's the chairman of the Senate Judiciary Committee, also echoed controversial calls from Trump, Donald Trump Jr., and his colleague Sen. Rand Paul of Kentucky for the name of the whistleblower who filed the complaint that sparked the inquiry to be publicly released.
"Yes, it should be made public," Graham said, according to CNN. "The whistleblower's claims cannot be used as a basis for criminal accusations, cannot be used the basis for impeachment based on anonymity."
Graham, who was one of Trump's sharpest critics during the 2016 campaign season, has developed a reputation as one of the president's closest allies in Congress. He rarely goes against Trump, though he did briefly break from this trend last month to excoriate the president's decision to abandon US-allied Kurdish forces in Syria.
