    Information for 2020/2021

    The Loughborough Development Trust Africa Scholarship will cover 100% of the course fees for your chosen postgraduate taught course for one year (replacing any Departmental or Loughborough University scholarships or bursaries you may already have been awarded).

    The scholarships are being funded through a combination of generous external funding and University funds. The University will award a limited number of scholarships, and the standards required are very high.

    Students will be expected to fund their travel and maintenance costs through other sources. Evidence of maintenance funds must be included in the scholarship application.

    Application Process and Eligibility Criteria

    For 2020 entry the scholarship application procedure is an open competition. Students may only apply for the scholarship after an offer for a place has been made. Students who are in possession of an offer (conditional or unconditional) of a place on a postgraduate taught course can apply for the scholarship using the application form which can be downloaded below.

     

     

    2020/21 application deadline: 30 April 2020

    Applications will be initially shortlisted and the final decision on the awards will be made by a selection panel of senior staff of the University. The selection panel will use the following eligibility criteria when assessing applications:

    • Currently domiciled (permanently living) in Africa
    • Evidence of exceptional academic achievement (normally a 1st Class Honours Degree)
    • Commitment to return to their home country on completion of postgraduate programme
    • Evidence of the ability and commitment to making a significant contribution to their home country on their return
    • Full understanding of the costs involved in coming to study and live in the UK
    • Evidence of strong motivation and initiative to secure funds to cover the remainder of the costs involved

    Applicants are advised to spend considerable effort ensuring that this application reaches the selectors in a form that is clear, well presented and which reflects your abilities and motivation.

    Selection process

    Each participating UK University will conduct its own recruitment process to select a specified number of candidates to be awarded Commonwealth Shared Scholarships. Universities must put forward their selected candidates to the CSC in March 2020. The CSC will then confirm that these candidates meet the eligibility criteria for this scheme. Universities will inform candidates of their results by July 2020.

    Applications will be considered according to the following selection criteria:

    • Academic merit of the candidate
    • Potential impact of the work on the development of the candidate’s home country

    Федеральный список объектов национального значения (ISOS) был создан в 1966 году. Список постоянно обновляется, и на настоящий момент в него включены 1 274 населенных пункта самых разных размеров – от крупных городов до небольших поселков. Цель этого перечня состоит в том, чтобы способствовать сохранению исторической застройки городов и архитектурного разнообразия Швейцарии, а также содействовать устойчивому городскому планированию. О важности списка говорит то, что решения о внесении изменений принимаются Федеральным советом.

    Многие из включенных в список ISOS городков представляют собой настоящие архитектурные «жемчужины», но до сих пор остаются неизвестными широкой публике. Федеральное управление культуры в сотрудничестве со Швейцарским туристическим офисом решило исправить эту несправедливость и отобрало два десятка городков, которые обязательно стоит посетить тем, кто путешествует по Швейцарии.

    В число самых красивых швейцарских деревень вошли Андельфинген (кантон Цюрих), Овернье (Невшатель), Бауэн (Ури), Кастазенья (Граубюнден), Дарданьи (Женева), Эрленбах-им-Зимменталь (Берн), Эрматинген (Тургау), Эрнен (Вале), Джорнико (Тичино), Халлау (Шаффхаузен), Ле-Пон (Во), Лесок (Фрибург), Маланс (Граубюнден), Моркоте (Тичино), Плежуз (Юра), Рюэггисберг (Берн), Сен-Сафорен (Во), Зент (Граубюнден), Соацца (Граубюнден) и Троген (Аппенцелль-Ауссерроден).

    Каждая из двадцати отобранных деревень является типичной для своего региона. Так, тичинские Моркоте и Джорнико напоминают исторические центры городов Пьемонта и Ломбардии. Моркоте – это бывший рыбацкий поселок, раскинувшийся на берегу озера Лугано, а расположенный чуть выше Джорнико знаменит своими старинными романскими церквями с высокими колокольнями, сложенными из серых камней.

    Граубюнденские коммуны пленяют своими альпийскими панорамами. Одним из самых живописных мест кантона считается расположенная у итальянской границы Кастазенья, которую окружают крупнейшие каштановые рощи в Европе. Небольшие каменные дома, стоящие вдоль проселочной дороги, раньше использовались для сушки каштанов, а сегодня открыты для публики.

    Граубюнден также славится памятниками эпохи барокко. Главной архитектурной особенностью Зента, например, является фигурный фронтон в барочном стиле, украшающий крыши домов. Эта деталь появилась в конце XVIII века благодаря тирольским мастерам. В долине Мезольчина, в окружении гор, спряталась Соацца, где можно увидеть прекрасную церковь Сан-Мартино, перестроенную в духе барокко в XVII веке. А в Малансе стоит побывать, чтобы посетить замок Ботмар, вокруг которого разбит один из самых красивых барочных садов Швейцарии.

    Городки Романдии отличаются французским флером: Овернье с его разновцетными фасадами домов и маленькими площадями с фонтанами, Дарданьи с замком с четырьмя угловыми башнями и, конечно, идиллический Сен-Сафорен, который находится в самом центре виноградников Лаво, внесенных в список Всемирного наследия ЮНЕСКО. Заметная архитектурная деталь Сен-Сафорена – аркады – появилась из-за необходимости защитить жителей от природных катаклизмов. Ранее городку угрожали оползни, поэтому власти решили возводить фасады домов на аркадах.

    Если же вы хотите полюбоваться историческими альпийскими шале, то отправляйтесь в немецкую часть Швейцарии. К ярким памятникам деревянного зодчества относятся музей Agensteinhaus в Эрленбах-им-Зимментале, мост через реку Тур в Андельфингене, шале в Эрнене и типичные бернские усадьбы с потемневшими деревянными фасадами в Рюэггисберге.

    How extreme events impact Earth’s surface: reports from the 6th EGU Galileo conference

    Throughout the year, EGU hosts a number of meetings, workshops, and conferences for the geoscience community. While the EGU’s annual General Assembly brings more than 15,000 scientists together under one roof, the EGU Galileo Conferences allows a smaller number of scientists to discuss and debate issues at the forefront of their discipline. In this blog post, the organisers of the 6th Galileo Conference “Perturbations of earth surface dynamics caused by extreme events” reflect on a week of insightful presentations and discussions on rare and catastrophic events. “How do extreme events perturb Earth surface dynamics?” This question kept us busy during the entire week of the 6th EGU Galileo Conference “Perturbations of earth surface dynamics caused by extreme events”, which took place in Nepal from 13-19 October 2019. As organisers, we had aimed for a slightly unusual conference venue. We kept the nice hotels to a minimum of two nights and took the participants out to the Bhote Kosi for some camping for the remainder of the week to foster discussions and idea exchange. The Bhote Kosi valley, about four hours’ drive north east of Nepal’s capital city Kathmandu, was heavily impacted by the April 2015 Gorkha earthquake and a subsequent glacier lake outburst flood event in 2016. This valley still today carries the signs of these earlier events in the form of large landslides, unstable slopes, and reworked river beds. As such, the valley serves as an ideal natural laboratory to better understand and quantify how the Earth’s surface responds to such perturbations. The Bhote Kosi had been a basecamp for a number of us studying natural hazards during the multiple field campaigns organised after the Gorkha earthquake, and this conference was a great opportunity to share what we have learned over the past years while directly illustrating the conference topics. What seemed easy in the early days of planning did not come without inevitable doubts as the conference came closer. How do we make sure we have enough tents for everyone, how do we deal with the frequent power cuts, how do we make sure to cater enough local beer to thirsty geoscientists, and what if everyone contracted food poisoning? Fortunately, 60 participants, including ten Nepali colleagues and many early career scientists, blindly followed us without much afterthought and we were off for a busy and promising week. The talks and posters covered most extreme event triggers: from earthquakes to volcanic eruptions and from wildfires to storms and tsunamis. These presentations provided food for thought for the geomorphologist, the geochemist, and the seismologist alike. This conference also highlighted the large range of possible geomorphic responses, both in terms of magnitude and spatial extent, suggesting that the question of how these extreme events should be defined (are they large or are they rare events?) should ultimately be left to the investigators. It is however clear that in terms of geomorphic impact, an extreme event should lead to an observable perturbation above a, to-be defined, background variability, and be followed by a recovery period that leads to an old or new steady-state. As such, extreme events are not created equal and future research is needed to understand why such a range of responses are encountered. Conference attendees had the opportunity to discuss questions and topics at the forefront of their field, from ethics in science to international cooperation. (Credit: Monique Fort)  Time for discussion also allowed us to debate on the morality of post-disaster scientific work. We concluded that basic research questions related to these events need to be pursued and frequently require immediate mobilisation of scientific equipment and personal. However, this discussion also highlighted the need for clear and transparent international coordination so as to not interfere with relief efforts and avoid being perceived as greedy ambulance-chasing scientists. This important discussion was backed by input from a large Nepali delegation, providing an insight into how they had perceived these questions directly after the recent earthquake. Further discussions focused on the commonalities of different extreme events and the possibility to define a common framework that would allow us to compare the geomorphic impact of an earthquake to that of a storm or a wildfire. Finally, this conference allowed us to lay the foundation blocks for future international coordination efforts. While the exact contours remain to be defined, all participants emphasised the need to prioritise research questions and resources in the case of rapid response efforts. These efforts require clear coordination with affected countries and funding bodies, but for instance also encourage scientific actors to agree on common publication strategies upfront. From small to large, the Bhote Kosi has it all: boulders, landslides, debris flows etc… Driving up the valley all the way to the Nepal-China border provides a humbling experience of how these idyllic landscapes can be turned into deadly traps in the blink of an eye. With closer scrutiny it becomes obvious that the whole landscape has been shaped by a myriad of these catastrophic events, directly questioning the notion of extremes. After six days of presentations, posters, and late night discussions, it was time to close this intense, yet educational week. In the end there weren’t too many power cuts, no one got sick, most of us managed to shower with hot water and only a few reported spiders in their tents. In line with the local Nepali customs, the end of the conference was celebrated by inspired dancing until late at night when the first shuttles back to the airport started to take people back to Kathmandu.     Bridging the Week by Gary DeWaal: October 21 to November 1, and November 4, 2019, (CFTC Settlement Undone; Aiding and Abetting Liability Potentially Broader; Spoofing = Wire Fraud)

    Two weeks ago, a federal court of appeals sided with the Commodity Futures Trading Commission ruling that a district court could not require the testimony of three commissioners and various staff to assess whether the agency committed civil contempt in connection with its handling of an enforcement settlement with two food giants. In response, the district court confirmed it would solely evaluate the existing record to determine whether to grant the defendants’ motion for a contempt finding against the Commission and sanctions; however, it also set aside the settlement consent order and instructed the parties to propose a trial date – although they could also propose new resolution terms. Last week, a law firm filed its own lawsuit against the CFTC for the agency’s non-provision of documents related to the settlement in response to a request under the Freedom of Information Act. Unrelatedly, the House Committee on Agriculture proposed to reauthorize the CFTC for another five years and to expand the reach of potential aiding and abetting liability to reckless acts in addition to purposeful acts. As a result, the following matters are covered in this week’s edition of Bridging the Week:

    • District Court Judge Calls for Do Over in Settlement of CFTC Enforcement Action Against Food Giants After Court of Appeals Mostly Grants Commission’s Mandamus Request: On October 23, the federal court judge in Chicago presiding over the 2015 enforcement action by the Commodity Futures Trading Commission against Kraft Foods Group, Inc. and Mondelez Global, LLC set aside the settlement agreement among the parties confirmed in an August 14, 2019 consent order. The CFTC originally charged the defendants with manipulating and attempting to manipulate December 2011 wheat futures contracts and cash wheat.

    The Hon. John Blakey revoked the settlement order following a decision by a federal court of appeals to grant, in part, relief requested by the CFTC in a mandamus petition precluding him from requiring the Chairman of the CFTC, two commissioners, and various employees of the Commission to provide testimony in a contempt proceeding against the CFTC and the individuals. Previously, the defendants requested that the CFTC and the individuals be held in contempt because they claimed the CFTC and the individuals had violated terms of a mutual gag agreement contained in the consent order when the Commission and two commissioners issued statements contemporaneously with publication of the order. The defendants also sought sanctions against the CFTC.

    Under the agreement, defendants agreed to remit a fine of US $16 million and not to violate various provisions of law relating to manipulation, wash sales, and speculative limits. The consent order made clear, however, that nothing in the order reflected an agreement or determination that the defendants violated any provision of applicable law. (Click here for details regarding this dispute in the article “Contempt and Sanctions Hearing Against the CFTC Arising From Manipulation Complaint Settlement Delayed to October 2” in the September 2, 2019 edition of Between Bridges.)

    The US Court of Appeals for the Seventh Circuit held that only the CFTC could potentially be held in contempt for violating the gag order and not any individuals, and that the determination of whether the CFTC was in contempt should be made by Judge Blakey solely on the basis of the existing record without any consideration of collateral evidence, including the testimony of any CFTC commissioners or employees.

    In response, Judge Blakey issued a docket entry noting that he would resolve defendants’ motion for contempt, sanctions and other relief relying solely on the existing record. He also set aside the consent order on the grounds that the “factual record” does not support a proposition that the parties agreed to settle their dispute with an understanding that the settlement terms were binding on the Commission but not on agents of the Commission, including commissioners and staff. Additionally, Judge Blakey requested that the CFTC and defendants renew their motions for summary judgment and propose a trial date during a hearing on November 20. Judge Blakey indicated that the parties may still try to settle this matter, however.

    Separately, the New York-based law firm of Kobre & Kim sued the CFTC in a federal court in NY, claiming that the Commission failed to produce documents related to the CFTC-Kraft/Mondelez settlement that it requested under the Freedom of Information Act. The law firm claims that it requested the documents because the original settlement failed to contain any findings of fact or conclusions of law, and thus the CFTC has left “the public in the dark” regarding its current theory of manipulation. According to the law firm, “[i]n effect, the CFTC negotiated a private resolution that left the industry without any intelligible guidance and with a potential misimpression that the legal theories asserted against [Kraft/Mondelez] had a sound legal basis.” (Click here to access a copy of Kobre & Kim’s Complaint.)

    Legal Weeds: In its petition for mandamus, the CFTC also requested that the civil contempt proceeding against it be ended. However, the Court of Appeals rejected this request, claiming that if a decision ultimately is rendered adverse to the CFTC, the Commission can appeal that outcome in the ordinary course. The Court of Appeals also declined to transfer the contempt proceeding to a different judge as asked by the CFTC, saying that Judge Blakey was in the “best position to decide as an initial matter” if a contempt determination was warranted.

    Following the Court of Appeals’ decision, Judge Blakey indicated that not only would he be considering the CFTC’s possible violation of the consent order, but also possible violations of the court’s prior orders, “including this Court’s orders making the settlement conference discussions private in conformity with traditional trial court practice.”

    Judge Blakey previously had suggested that the Commission as well as individual commissioners and staff might be subject to criminal contempt determinations. However he withdrew this threat on September 19. (Click here to access the relevant docket entry at 336.)

    Judge Blakey’s pronouncement on the wide scope of his contempt determination coupled with Kobre & Kim’s FOIA lawsuit against the CFTC on Halloween serve to underscore how the Commission’s initial handling of its settlement with Kraft and Mondelez will continue to haunt the agency for some time.

    • House Ag Committee Proposes CFTC Reauthorization That Includes Aiding and Abetting Expansion: The House of Representatives' Agriculture Committee proposed a bill to reauthorize the Commodity Futures Trading Commission through fiscal year 2025 that includes a material expansion of potential aiding and abetting liability. Currently, under relevant law, any persons who willfully aids and abets a violation of law can be held liable for such violation as a principal (Click here to access 7 U.S.C. § 13c(a)). As proposed by the Agriculture Committee, any person who recklessly provides substantial assistance to such a violation could also be liable as a principal. 

    Additionally, the proposed reauthorization bill would (1) amend core principles for contract markets and swap execution facilities to require the CFTC to adopt rules detailing trader data and other information such trading venues must be able to access from cash markets and other data sources related to contracts referencing digital commodities and (2) expand the reach of the CFTC’s enforcement authority outside the United States to circumstances where certain prohibited activities (e.g., fraud and manipulation) “have or would have a reasonably foreseeable substantial effect within the United States.” 

    As proposed, the CFTC would also be required to adopt policies to safeguard proprietary information it receives whether through investigations or otherwise proportionate to the “level of sensibility of the information” and limit access to the information to “appropriate” Commission staff.

    My View: In light of the CFTC’s relentless prosecution of Jitesh Thakkar for developing software used by Flash Crash Spoofer Navinder Sarao despite the dropping of parallel criminal charges by the Department of Justice, the proposed expansion of potential aiding and abetting liability for non-registrants is a significant red flag. Potentially holding programmers of futures trading, advisory or surveillance systems liable for the non-intentional development of software that might be used for illicit purposes could have a material chilling effect on software development for legitimate purposes and inhibit US leadership in creating new fintech innovations for the derivatives industry.     • Spoofing Can Violate Wire Fraud Statute Rules Federal Judge: A federal district court in Chicago declined to dismiss criminal charges alleging violations of wire fraud prohibitions against James Vorley and Cedric Chanu related to alleged spoofing trading activities on the Commodity Exchange, Inc. from at least December 2009 through November 2011. Both individuals were formerly associated with Deutsche Bank and were named in a criminal complaint filed in July 2018. (Click here for background in the article “Alleged Spoofer Exonerated in Criminal Trial Agrees in Principle to CFTC Settlement; Two More Purported Spoofers Criminally Charged” in the August 5, 2018 edition of Bridging the Week.) The defendants were charged both with wire fraud (Click here to access 18 U.S.C. §1343) and with conspiracy to commit wire fraud (click here to access 18 U.S.C. §1349).

    ​The defendants had argued that they could not be convicted of wire fraud because a violation under the relevant statute requires the making of affirmative misrepresentations and spoofing trading does not entail false statements. According to defendants, their orders – even if spoofing orders – entailed no representations beyond their stated terms and solely communicated an implied commitment that if their orders were accepted before cancelled, they would be filled according to their terms.

    The Hon. John Tharp, Jr., the presiding judge in this matter, disagreed with defendants’ arguments. He wrote that omitting or concealing material information, even absent a duty to disclose, constitutes a violation of wire fraud prohibitions “if the omission was intended to induce a false belief and action to the advantage of the schemer and the disadvantage of the victim.” Judge Tharp claimed that when orders are placed with an intent to cancel them before execution in connection with spoofing, the intent is to create a “false belief about the supply or demand for a commodity” so that a market moves in a direction to execute resting orders of the spoofer on one side of the market to the detriment of other traders on the other side of the market who are not knowledgeable of the spoofer’s trading intent.

    The court also rejected defendants’ argument that the wire fraud statute is unconstitutionally vague. Judge Tharp wrote that spoofing is similar to pump and dump schemes that have frequently been prosecuted under wire fraud prohibitions.

    The Dodd Frank Wall Street Reform and Consumer Protection Act that contained an express spoofing prohibition was not signed into law until July 21, 2010, and the anti-spoofing provision was not effective until July 16, 2011. Thus, the DOJ could not prosecute defendants utilizing the prohibition for the overwhelming majority of their purportedly illicit spoofing transactions.     Policy and Politics: In February 2019, the Futures Industry Association filed a friend of the court brief in this matter arguing that prosecuting defendants for wire fraud (and not spoofing) raised issues of concern to the business community because such action implied that orders entered without an intent of execution for any reason constituted fraudulent statements to the marketplace. However, observed FIA, such a view would challenge “the vitality of the established legal precept” that market participants have no obligation to disclose any information in connection with open orders including their intentions regarding such orders. According to FIA, criminalization of “a market participant’s failure to disclose trading intentions opens the door for arbitrary prosecutions and vexatious private claims.” (Click here to access a copy of the FIA filing.) The US Chamber of Commerce, the Bank Policy Institute and the Securities Industry and Financial Markets Association made similar arguments in a friend of the court brief they also filed in this matter.

    More Briefly:

    • CFTC Chair Says Position Limits Proposal Coming Soon; Head of DSIO Says Thematic Reviews Coming Soon Too: In a kick-off speech before FIA Expo in Chicago last week, Heath Tarbert, Chairman of the Commodity Futures Trading Commission, said the Commission will propose new position limits rules within the next few months. He also said that, among his other objectives, were issuance of a framework for principles-based regulation generally, principles guidance for digital assets, enforcement penalty guidance, and a cross-border rule for swap dealers. Although he associated no specific time frames with his other objectives, Dr. Tarbert quoted Thomas Edison in saying that “vision without execution is hallucination.”

    Separately, Joshua Sterling, Director of the CFTC’s Division of Swap Dealer and Intermediary Oversight, indicated that his Division staff would soon commence targeted thematic reviews of swap dealers and commodity pool operators. In a speech before the Alternative Investment Management Association, Mr. Sterling said the purpose of the review would be “both to mitigate the potential for blind spots in our oversight and enhance our engagement with registrants.” According to Mr. Sterling, firms subject to reviews are those likely “to have a significant impact” on derivatives markets and each review would be completed onsite within five business days. The objective of the reviews is not to refer matters to the Division of Enforcement, he said, but to provide general guidance to the industry and determine potential rulemakings.

    • US and Non-US Companies Charged by CFTC for Acting as Unregistered FCMs: XBT Corp. SARL d/b/a First Global Credit (FGC) settled charges brought both by the Commodity Futures Trading Commission and the Securities and Exchange Commission that if offered and sold investment products to US person in return for payments in bitcoin in violation of certain legal provisions. According to both regulators, FGC is a Switzerland-based company that maintains a website and platform to solicit customers to trade futures and securities products.

    The CFTC alleged that, from March 2016 through July 2017, FGC solicited and allowed US persons to trade futures on the Chicago Mercantile Exchange’s Globex platform without being registered as a futures commission merchant. The SEC charged that from 2014 through 2019, the firm offered and sold instruments based on US and internationally listed stocks to US persons that did not meet certain minimum financial standards by qualifying as “eligible contract participants” under applicable law (Click here to access a definition of an ECP at 7 U.S.C. §1a(18)). However, as these instruments constituted security-based swaps, they could only be sold to nonqualified US persons if the instruments were subject to an effective registration statement and were traded on a national securities exchange. FGC met neither of these requirements, alleged the SEC.

    FGC settled with the CFTC and SEC by agreeing to pay each a US $100,000 fine. FGC additionally agreed to remit to the SEC US $32,952 as disgorgement and interest.

    Unrelatedly, Upstream Energy Services LLC, a Texas-based crude oil and natural gas advisory firm, was also charged by the CFTC with operating as an FCM without registration. The CFTC claimed that between April 2017 and September 2018, the firm accepted orders for futures and options on behalf of two clients owned by the same person, and entered the orders and carried the resulting trades in its own trading accounts. Upstream extended credit to the clients for margin but was subsequently reimbursed by the clients for Upstream’s costs; Upstream also received fees from the clients for its trading services. Upstream agreed to pay the CFTC a US $75,000 fine to resolve its purported violation.

    • No Action Granted by SEC to NY Digital Trust Company to Settle Equities Transactions Without Clearing Agency Registration: Staff of the Securities and Exchange Commission granted Paxos Trust Company, LLC no action relief to act as a clearing agency for two years without registering as a clearing agency in connection with a private and permissioned distributed ledger system designed to facilitate simultaneous delivery vs. payment securities settlements. As a condition of its no action relief, Paxos will provide its offering to no more than seven participants; limit its services to a de minimus amount of activity; and solely settle equities that meet certain criteria. Paxos’s proposed settlement system will piggyback on existing structures by creating and utilizing digital representations of cash wired by broker-dealer participants to a Paxos bank account and digital representations of securities transferred by the same broker-dealers from their The Depository Trust Company accounts to a Paxos DTC account. According to a press release issued by Paxos, Credit Suisse and Société Générale will be among the first participants to use Paxos’s settlement services (Click here to access Paxos’s press release).

    In other legal and regulatory developments involving Fintech:

    • DOJ Relies on Bitcoin Block Chain Analysis for Indictment of Leader and Users of Darknet Child Pornography Website: The Department of Justice quarterbacked the indictment of the founder of a darknet child pornography website – Welcome to Video ("WTV") – by a grand jury in the District of Columbia, and the arrest and charging of 337 site users nationwide and abroad. According to the DOJ, by tracing transactions on the bitcoin blockchain, it was able to identify the site’s alleged leader – Jong Woo Son — and the location of the site’s server’s physical location in South Korea. With analytic help from a private company, Chainalysis, DOJ was also able to identify the exchanges on which bitcoin was initially purchased for use on WTV, thus allowing the DOJ to identify potential users by relying on the exchanges’ know-your-customer information.     • CFTC Chair Stresses Need for Principles-Based Regulation to Accommodate Fintech and Announces Elevation of LabCFTC to Operating Office: Heath Tarbert, Chairman of the Commodity Futures Trading Commission’s, indicated that innovation in the derivatives industry can best be encouraged by providing a “principles-approach to regulation.” Contemporaneously, during a presentation at the beginning at the CFTC’s Fintech Forward 2019 conference on October 24, Dr. Tarbert announced the elevation of LabCFTC to an independent operating office within the Commission (as opposed to a part of the Office of General Counsel) and the CFTC’s new membership in the Global Financial Innovation Network. GFIN is an organization of global regulators that encourages cooperation in the development, execution and distribution of new technologies. In connection with the Fintech Forward conference, LabCFTC also issued a primer on Artificial Intelligence (click here to access). The Securities and Exchange Commission, the Federal Deposit Insurance Corporation  and the Office of the Comptroller of the Currency also announced they joined GFIN last week (click here for background).

    • OCC Loses Effort to Have Scope of DFS Judgment Limiting National Fintech Charters Narrowed: A federal court in New York City granted the New York Department of Financial Services’ request for an order precluding the Office of the Comptroller of the Currency from approving fintech applicants who do not accept deposits for national bank charters. Both parties had agreed to the general framework of a proposed order mandating such outcome, but OCC had sought to limit its application solely to fintech applicants that had a nexus to New York State. Previously, the same court had ruled that NYS had standing to bring its legal action. (Click here for background in the article “Federal Court Opens Spigot Permitting NY DFS Lawsuit to Proceed Against Federal Bank Regulator for Planning to Issue Fintech Charters” in the May 5, 2019 edition of Bridging the Week.) In September 2019, a federal court in the District of Columbia ruled that the Conference of State Bank Supervisors had no standing to bring an analogous action against OCC, writing that the organizations' claims were unripe as, to date, no fintech company has applied for a relevant charter.     • Purported Faulty Block Trade Reporting, Prearranged Trading to Obtain Exchange Incentive Fees and Failure to Supervise Result in NYMEX Disciplinary Action Settlements: McNamara Options Ltd. agreed to pay a fine of US $70,000 to resolve charges brought by the New York Mercantile Exchange that it failed to accurately reflect execution times on multiple block trade submissions and failed to report such block trades within required time frames. NYMEX also alleged that the firm did not “properly” train its employees regarding its requirements to accurately reflect the execution time of block trades on submissions. 

    Unrelatedly, Ze Qian, a nonmember, resolved an unrelated disciplinary action by NYMEX that claimed he prearranged the execution of transactions involving steel futures between an account he traded for his employer and an account owned and controlled by another person to enable Mr. Qian’s employer to receive trade credits from a market-maker incentive program administered by the exchange. To resolve this matter, Mr. Qian agreed to pay a fine of US $5,000 and serve a two-year all CME Group exchanges’ access ban. 

    Additionally, three nonmembers were all fined either US $40,ooo or US $50,000 by the Commodity Exchange, Inc. or NYMEX and permanently barred from accessing CME Group exchanges for trading for engaging in spoofing trading. The three persons are Shiv Agarwal, Krishna Lakani and In-Ho Hwang. Finally, Boston Metal Co., Ltd was also sanctioned US $40,000 for failing to supervise one of its employees who allegedly engaged in spoofing trading and for not ensuring that each of its traders used a unique Tag 50 identification when placing electronic orders.

    • Two Affiliated Broker-Dealers Agree to US $15 Million Sanction for Purported AML Program and Supervisory Deficiencies: BNP Paribas Securities Corp. and BNP Paribas Prime Brokerage, Inc. agreed collectively to pay a fine of US $15 million to resolve allegations by the Financial Industry Regulatory Authority that, from February 25, 2013 through March 31, 2017, they failed to maintain and administer an adequate anti-money laundering program. Among other matters, FINRA claimed that until 2016, the firms did not conduct surveillance of penny stock transactions or transactions outside of traditional exchanges despite the heightened risks of such transactions including fraud, money laundering and lack of registration of such stocks with the Securities and Exchange Commission. The firms reviewed wire transfers involving US dollars, acknowledged FINRA, but purportedly failed to monitor wires involving foreign currencies or any wires to assess whether they involved high-risk jurisdictions or entities. FINRA claimed that during the relevant time, some employees of the firms escalated concerns regarding the adequacy of their AML program to senior management; however, said FINRA the firms “did not act in a timely manner to address the deficiencies its personnel identified.” FINRA indicated it considered the firms’ remediation efforts which commenced during its review in computing the amount of the firms’ fine.

    • Trader Accused by SEC of Making Misstatements Regarding Bond Pricing Asks for Summary Judgement Claiming Practices Were Industry Norm: James Im, who was sued by the Securities and Exchange Commission in 2017 for purportedly engaging in fraud by misrepresenting information related to commercial mortgage-backed securities he sold to customers, supported a motion for summary judgment in his favor by arguing that while his statements may have been misleading, they were not materially misleading and, in any case, none of his customers relied on them. This is because, claimed Mr. Im, none of Mr. Im’s customers would have considered his statements in assessing the value of the bonds he sold or whether to purchase them as they engaged with him solely on a principal to principal basis and he never acted on their behalf as an agent. Moreover, said Mr. Im, at no time did he act with scienter or recklessly because his misstatements were solely “negotiating positions [and] nothing more”, and “market participants understood that such misstatements were not uncommon.” Mr. Im was previously co-head of the CMBS desk at Nomura Securities International, Inc.     Ron Prosor: For UNRWA, the party is over
    When I heard that United Nations Relief and Works Agency for Palestine Refugees in the Near East Commissioner Pierre Krahenbuhl resigned, I was shocked. After all, the UN does not have the best track record when it comes to investigating corruption allegations against its own agencies, let alone when it comes to the UNRWA, which until recently had airtight immunity from criticism.

    For 70 years, UNRWA has been something of a separate entity in the UN, one dedicated solely to the issue of Palestinian "refugees," alongside the agency that handles all other refugees – the UNHCR. But unlike the former UNRWA never even tried to solve the refugee problem and seemed dedicated to perpetuating it.

    Case in point: When UNRWA was founded in 1949, there were around 700,000 Palestinian refugees in the world. Today, their number stands at 5.7 million.

    But UNRWA's data must always be taken with a grain of salt, as they tend to artificially inflate. A census that took place in Lebanon in 2017 found that 300,000 people included in the agency's data simply do not exist and that the true number of Palestinian refugees in Lebanon was 66% smaller than stated on its reports.

    At the same time, the budgets appropriated to UNRWA put the UN's actual refugee agency to shame.

    Not only is UNRWA's budget per-refugee four times greater than that of any other refugee, it employs 30,000 people. The UNRCR, which deals with 70 million refugees, employs only 10,000 people.

    But it seems that UNRWA's party is coming to an end.
    Head of Shin Bet: We thwarted over 450 terror attacks in the past year
    Head of Shin Bet Nadav Argaman claimed on Thursday that the Shin Bet thwarted over 450 terror attacks in the past year. Argaman spoke at the Unmanned Systems Conference, UVID 2019, initiated by Israel Defense.

    "We are an agency with excellent people, the best technology and synergy within the agency and with Israeli security authorities, which allows us to have an edge on very challenging enemies," Argaman said. "All that allowed us to thwart over 450 terror attacks in the past year and try to provide the citizens of Israel with safe and peaceful daily life without knowing what happens behind the scene."

    Meanwhile, the IDF mapped on Thursday the house of Kassem Shabli, one of the terrorists who carried out an attack near the West Bank town of Dolev in August, in which 17-year-old Rina Shnerb was murdered.

    The mapping was done in order to prepare for the demolition of the house in Kfar Kobar on Wednesday night.

    Kassem a-Karim Ragah Shabli, 25, a member of the PFLP, has been arrested in the past for involvement in terrorist activities. Kassem provided the explosives that were used in the IED as well as assisted in assembling it, and took part in the killing of Shnerb.

    Two other terrorists were arrested for involvement in the attack.

    PMW: Why is Martyrdom-death “unique in Palestine”?
    Death as a "Martyr" for Allah and for "Palestine" - during terror attacks and other violent confrontations with Israel - has been promoted as an ideal by the Palestinian Authority for years, as documented by Palestinian Media Watch.

    The elevated status "Martyrs" enjoy in the PA was recently stressed by a host on official PA TV, who bragged that "Martyrdom in Palestine is unique," because a Martyr's funeral is considered "a wedding." A mother of a "Martyr" present in the TV studio expressed her opinion that death as a Martyr is "an honor":

    A Martyr's funeral is considered a wedding to the 72 Virgins in Paradise in Islam.

    These expressions of support for dying as a "Martyr" come as no surprise. PMW has documented numerous mothers and fathers who have expressed joy when their terrorist children died as "Martyrs." This is what the PA has taught them and what is expected of them. The following are examples of mothers praising their dead children's Martyrdom, collected in one video (additional texts below):

    "I hold my head high. The honor is mine. I have a son who is a Martyr." [Official PA TV, Sept. 24, 2002]

    Apartheid on Temple Mount: Police Block Jews from Using Drinking Fountains
    Zionist watchdog group Im Tirtzu on Wednesday released a video showing Israeli police officers physically blocking Jewish visitors on the Temple Mount from using the compound’s water fountain.

    Im Tirtzu’s Tamir Baram, who was among the Jews prevented from drinking water on the Temple Mount, said: “We’ve gotten to such an absurd situation on the Temple Mount in which something so elementary as drinking water is being prevented from Jews. For those who forgot, the Temple Mount is Judaism’s holiest site – and we deserve to be treated there with respect rather than with discrimination.”


    Netanyahu requests U.S. transfer funds to PA, Trump refuses
    Prime Minister Benjamin Netanyahu requested that Washington allow the transfer of $12 million to Palestinian security forces, but President Donald Trump denied the request, Channel 13 reported.

    “If it’s so important for Netanyahu, he should pay the Palestinians $12 million,” Senior White House officials told Channel 13, quoting the president.

    Netanyahu's administration was supposedly one of the key factors in Trump's decision to cut aid to the Palestinians in the first place, i24 reported. The cuts were made slowly over time, but the US State Department found that the money was still being transferred to Palestinian security forces, according to Israel National News.

    Israeli ambassador to the US Ron Dermer, among other Israeli officials, reportedly asked the US to allow the transfer.

    "All US security assistance to the PA has ceased," a US official told Axios. "The US security coordinator and his team continue to conduct a security cooperation-only mission. These activities are not funded with foreign assistance resources."

    The transfer of funds did not occur, according to Israel National News.
    Security Agencies in India on Alert for Possible Terrorist Attacks on Jewish, Israeli Targets
    Security agencies in India are on alert for possible terrorist attacks on the country’s Jewish community or visiting Israeli tourists.

    News site DNA India reported that both al-Qaeda and ISIS could both be involved in such attacks, as intelligence agencies have traced messages being shared online by the terror groups.

    In addition, a jihadist group in the southern state of Kerala may be collecting information on the Jewish community in the district of Kochi. Kochi is home to the Cochin Jews, an ancient community most of whose members have immigrated to Israel.

    There may also be plans to kidnap Israeli tourists in the country. India is a popular destination for Israeli travelers, especially for young Israelis who have just finished their military service.

    DNA speculated that the terror groups could also be motivated by Israel’s support for the Indian government’s decision to impose direct rule on the disputed Kashmir region.
    Netanyahu lauds pro-Israel fmr Canadian PM Stephen Harper
    RELATING TO the project that will link Harper’s name in perpetuity with the State of Israel, Netanyahu said that Israel is a hub on many levels, including bird migration from Europe to Africa and back. He saw the center as an important facility for ornithological research, combining beauty and science.

    In a reference to the many friendships that Israel has developed over the years with the leaders of different countries, Netanyahu said that, “the best friendship is based on an alliance of values. Stephen has stood up for these values time and again.”

    Harper, acknowledging that he is not supposed to be partisan in another country, recalled that he had first come across Netanyahu in the 1980s and had seen him on television when he had “virtually exploded off the screen.” He had predicted at the time that Netanyahu would one day become prime minister of Israel.

    Not only did that happen, he said, but Netanyahu had become Israel’s longest serving prime minister and had transformed the country and its image on the world stage.

    Harper described Netanyahu as “the most consequential figure in the history of the State of Israel.”
    Bipartisan group of US congresswomen visits to show ‘no daylight’ on Israel
    A bipartisan delegation of women members of Congress is visiting Israel this week to underline that there is “no daylight” between the Democratic and Republican parties when it comes to ensuring the strength of US-Israel relations, and in supporting Israel as a Jewish, democratic state, the leader of the group said Thursday.

    Speaking to The Times of Israel by phone as the delegation toured the country, Debbie Wasserman Schultz, a Democrat of Florida, said the group had met with Prime Minister Benjamin Netanyahu, Blue and White party leader Benny Gantz, and former chief Palestinian negotiator Saeb Erekat, and found it “heartwarming” to hear how similar they sounded about the imperative to enable Israelis and Palestinians to “live side by side in peace.”

    Two other members of the delegation were also on the call — Martha Roby (a Republican of Alabama) and Angie Craig (a Democrat of Minnesota). The delegation also included Congresswomen Bonnie Watson Coleman, Brenda Lawrence, Mikie Sherrill and Susie Lee.

    Asked about concerns in Israel that some high-profile members of the Democratic party have been loudly critical of Israel, and that three Democratic presidential candidates — Bernie Sanders, Elizabeth Warren and Pete Buttigieg — have talked of leveraging US military aid in order to compel Israel to change its policies on settlements and the Palestinians, Wasserman Schultz replied: “Quite the contrary: The message given to us, particularly by Prime Minister Netanyahu, is that he does not perceive or believe that there is any erosion of support.”
    Jewish Democratic congressman visiting W. Bank blasts treatment of Palestinians
    A Democratic congressman from Michigan has criticized Israel for its treatment of Palestinians following a tour of the West Bank earlier this week.

    Rep. Andy Levin said Wednesday he was enraged by the situation in Susya, where Palestinian villagers are denied water access, while Jewish settlers nearby are granted government-supplied amenities.

    “Yesterday, I traveled to the southern West Bank, including the Palestinian village of Susya, which the Israeli government has destroyed twice and currently denies access to water,” he wrote. “Yet we watched the government utility, right before our eyes, lay in pipes right across the village’s land to deliver tap water to an illegal Israeli outpost nearby.” He did not name the outpost.

    Israel has several times in the past demolished Palestinian buildings in Susya, saying they were built without permits.

    “It was simply incredible. As angry as the situation made me, the resilience of the Palestinian villagers left an even stronger impression,” wrote Levin, a former synagogue president and chair of the steering committee of Detroit Jews for Justice.
    French far-left leader accuses Jews of 'violent sectarianism'
    The leader of the French far left accused French Jews of inciting to assault him and promoting “violent sectarianism” that he said doesn’t occur among Muslims.

    Jean-Luc Melenchon, leader of the France Unbowed movement, inveighed against the CRIF federation of Jewish communities and organizations on Sunday during a televised interview with France Inter.

    “Sectarianism’s always been a problem for the republican idea,” Melenchon, who has been accused of anti-Semitic rhetoric in the past, said. “Take CRIF. It practices blatant, violent and aggressive sectarianism, namely against me, right? To the point of encouraging people to hit me during a demonstration like the one for Mirelle Knol.”

    Mirelle Knol was a Holocaust survivor who was murdered in her Paris apartment last year, allegedly by a Muslim neighbor. CRIF asked Melenchon and the leader of the rightist National Rally party, Marine Le Pen, not to attend a commemorative march for Knol. Both politicians came to the march, where participants booed them until police escorted them away.

    CRIF did not call for violence, which did not occur at the event, and condemned the booing.

    Melenchon, who continued to call CRIF “bizarre, folkloristic and ridiculous,” did not name any other group as responsible for sectarianism.
    BREAKING: Ex-Twitter Employees Charged For Spying For Saudi Arabia, Reports Say
    The Department of Justice announced on Wednesday charges against two former Twitter employees for allegedly spying for Saudi Arabia which analysts believe is the first time that the United States government has accused Saudi Arabia of spying in the United States.

    The two former Twitter employees that were charged are Ahmad Abouammo, who reportedly is a U.S. citizen, and Ali Alzabarah, who is a Saudi citizen.

    In a statement, the DOJ wrote that the “information could have been used to identify and locate the Twitter users who published these posts.”

    Prosecutors alleged that Abouammo “spied on the accounts of three users — including one whose posts discussed the inner workings of the Saudi leadership – on behalf of the government in Riyadh,” The Washington Post reported. Abouammo was also charged for allegedly “falsifying an invoice to obstruct an FBI investigation.

    Prosecutors accused Alzabarah of “accessing the personal information of more than 6,000 Twitter accounts in 2015 on behalf of Saudi Arabia,” The Post added. “One of those accounts belonged to a prominent dissident, Omar Abdulaziz, who later became close to Jamal Khashoggi, a Washington Post columnist who was killed by Saudi government agents last year.”

    A second Saudi national, Ahmed Almutairi, was also charged for allegedly spying as prosecutors say that he acted as a middle man between the Saudi government and the two Twitter employees.
    ‘They Are Leading by Leaps and Bounds’: South African President Cyril Ramaphosa Lauds Israeli Economic Innovation in Policy Speech
    South African President Cyril Ramaphosa lavished praise on Israel’s technology sector during a recent major economic policy address to women business leaders in Johannesburg, describing it as a model for his own country to follow.

    When it came to growth and innovation, Israel was “leading by leaps and bounds,” Ramaphosa told the 2019 Presidential Dialogue of the Businesswomen’s Association of South Africa on Oct. 29.

    “They are innovative in a number of sectors in the economy — in agriculture, in maritime, in many other areas,” Ramaphosa said, in remarks that were also broadcast live on South Africa’s national television network.

    “They have shown that they can lead, and we can learn a lot from what they do,” he said.

    Ramaphosa’s comments about Israel came in response to an audience question from prominent venture capitalist Polo Leteka — the co-founder of IDF Capital, a South African-owned equity firm that invests in businesses owned by black women.

    Leteka told Ramaphosa that Israel’s status as a global technology leader had been secured by the financial support of its government.

    “It was the government of Israel who put up a challenge fund back in 1992 — it was essentially a matching fund that put millions of dollars into the private sector,” Leteka said. “That’s how the industry there has developed as it has.”
    Iran said to pull out of deaf futsal championships to avoid facing Israeli team
    After the Iranian Judo federation was banned by international sports authorities from all competitions over its boycott of Israeli athletes, another Iranian sports team has reportedly pulled out of a competition to avoid facing an Israeli squad.

    Israel and Iran were placed in the same group in the upcoming World Deaf Futsal Championships, along with Argentina and Sweden. Israel was due to play against Iran on Saturday.

    The Iranians said they wouldn’t show up to the tournament in Switzerland unless they were moved to a different group, Israel’s Kan public broadcaster reported Thursday. When that didn’t happen, they withdrew from the competition entirely.

    Futsal is similar to soccer, with five players per side on a small court.

    The Iranian team had won the Asia Pacific Deaf Futsal Championships in February.

    Iran does not recognize Israel as a country and Iranian sports teams have for several decades had a policy of not competing against Israelis. Iranian passports remind holders in bold red that they are “not entitled to travel to occupied Palestine.”

    Last month, the International Judo Federation (IJF) banned Iran from competition indefinitely over the country’s refusal to face Israeli competitors.
    Jordan bans Israeli farmers from border enclave
    The Jordanian government announced that as of Sunday, Israeli farmers will be banned from entering the Naharayim enclave, Jordan Valley Council head Idan Greenbaum said Thursday.

    Under the 1994 peace agreement with Jordan, the Naharayim enclave and the Tzofar enclave were leased to Israel for 25 years, allowing the Israeli farmers living in the enclave to continue managing their farms.

    About a year ago, the Hashemite Kingdom announced that it wanted to terminate the lease agreement and take over the two enclaves.

    Various attempts were made both in public and in private to change the Jordanian decision, but the decision is apparently final.

    About a month ago, a Naharayim farmer in the Jordan Valley approached with an urgent letter to King Abdullah II and asked him to stop the process of restoring the enclave to the possession of the Kingdom of Jordan.

    Idan Greenbaum wrote to the Jordanian King on behalf of all the farmers of the Naharayim enclave: "I am taking an extraordinary step of writing directly to you, to prevent what is a disaster for us. I sincerely ask you to have the opportunity to present our suggestions to you or to someone you trust, through a meeting with us at the Island of Peace itself.
    Khaled Abu Toameh: Hamas bans rally to commemorate Yasser Arafat
    The Palestinian ruling Fatah faction on Thursday accused Hamas of banning Palestinians in the Gaza Strip from holding a rally to commemorate former Palestinian Authority President Yasser Arafat on the 15th anniversary of his death.

    Fatah had called on its supporters to gather on Thursday afternoon at the Square of Unknown Soldiers in Gaza City to mark the anniversary of the death of Arafat, who died on November 11, 2004. Another event, planned for next Monday, has also been banned by Hamas.

    The ban came as Fatah and Hamas have been holding indirect negotiations on PA President Mahmoud Abbas’s initiative to hold new Palestinian parliamentary and presidential elections.

    Mahmoud al-Aloul, deputy chairman of Fatah, said that the ban shows that Hamas’s announcement welcoming the new elections is nothing but “slogans.”

    The ban, Aloul said, is a “frustrating and unreasonable message” from Hamas.

    He said that Fatah was optimistic that matters were moving in the right direction after Hamas welcomed Abbas’s initiative to hold long overdue elections. “But Hamas took this unwise and unexpected decision to ban the event commemorating Arafat,” Aloul added.
    Gaza Protests Erupt after Police Throw Arrested Man Out the Window of His Home
    A rare public anti-Hamas protest took place in Gaza following the death of a 28-year-old man who’d been thrown from the window of his own home by the terror group’s security services.

    Three Hamas police officers arrived at the home of Anan Abu Jameh in the city of Khan Yunis in southern Gaza last Friday. According to the family, the security forces went upstairs to his room, arrested him and then threw him out of the window of his room. He sustained a serious injury to his head and later died from his wounds in the hospital.

    "They knocked on the door very hard and as soon as I opened it they said, 'We want Anan,’” said the father. He said he had asked to see a search warrant but was pushed aside by Hamas men who told him they will “do whatever we want.”

    The 28-year-old had recently graduated from a local university with a degree in communications and journalism.

    The incident led to an uproar among the local residents, who labeled Anan’s death as a "cold-blooded murder." The subsequent protests forced the Hamas police spokesman to make a statement, presenting a different version of events where the 28-year-old was arrested based on a warrant for his arrest.

    The police did not specify what the victim was accused of, but claimed Abu Jameh tried to evade the arrest by jumping from his window onto the nearby tree, from where he fell and sustained fatal wounds.

    Abu Jameh's family rejected the police’s account of events, calling it a gross lie. The family also added the police didn’t try to investigate the circumstances of their son’s death at any point.

    During Abu Jameh’s funeral in Khan Younis a rare anti-Hamas demonstration erupted, with the participants chanting: “Hamas are murderers.”
    Middle East: The Anti-Iran Revolution is Well Underway
    Iran's attempts to expand its malign influence throughout the Middle East have suffered a severe setback as a result of the unprecedented anti-government protests that have erupted in Lebanon and Iraq in recent weeks.

    The most obvious source of discontent in these two key Arab states has been the endemic corruption that has taken hold in both Beirut and Baghdad; in both countries, it has been the prime motivation in persuading tens of thousands of demonstrators to take to the streets.

    The desire to end corrupt practices and force the governments in Beirut and Baghdad to undertake a radical overhaul of their respective countries' governments is, though, only part of the story.

    The nationwide protests taking place in both Arab states are also driven by a burning desire to end Iran's blatant attempts to turn them into de facto fiefdoms of Tehran.

    Iran's attempts to seize control of the political agenda in Lebanon dates back to the early 1980s, when Iran established its Hezbollah militia in the southern part of the country to launch a series of terrorist attacks against Israeli forces operating in the area. Since then, Hezbollah -- with Iran's backing -- has gradually extended its influence in the country to the point where Hezbollah is now widely recognised as Lebanon's most influential political organisation.


    Seth J. Frantzman: U.N. slams bleeding Iraqi protesters for closing roads, harming oil supply
    The Special Representative for the UN Assistance Mission for Iraq slammed protesters for closing roads and disrupting oil on its way to ports, raising the ire of Iraqis who wonder why the UN cares more about oil and roads than people’s lives. It came days after the UN Secretary-General visited Turkey and appeared open to a plan by Turkey to settle Syrian refugees in an area that 200,000 have been forced to flee from due to fighting, leading to questions about the overall UN blind-spot on suffering in the region.

    Jeanine Hennis, a Dutch politician who serves as a diplomat and Special Representative of the Secretary-General in Iraq, tweeted on Wednesday that the protests in Iraq, where more than 200 protesters have been shot by security forces, are disrupting critical infrastructure.

    “Also of grave concern. Responsibility of all to protect public facilities. Threats, closure of roads to oil installations, ports causing billions in losses. Detrimental to Iraq’s economy,” she wrote.

    It was undermining fulfilling the protesters’ legitimate demands.

    “Losses to whom?” wondered the Twitter account Mosul Eye, which is run by survivors of the ISIS occupation of Mosul. “Most young Iraqis have no work. The schools are bare. The hospitals are completely unsupplied. No electricity. No assurance of clean water.”
    JCPA: Iran’s Strategy: Negotiate Using the Threat of Reneging on Its Commitments
    Spokesman of the Atomic Energy Organization of Iran (AEOI), Behrouz Kamalvandi said Iran would begin transferring nuclear materials to the Fordow site on November 6, 2019, as part of its fourth phase of reneging on its nuclear agreement obligations. He made it clear that the nuclear agreement prohibited Iran from transferring any nuclear material to Fordow, “but Iran is in the process of transferring nuclear material to the site.” He added that the International Atomic Energy Agency (IAEA) was updated that the transfer of nuclear materials – before being fed into centrifuges – would take place on November 6, 2019. The spokesman said that by the end of the week, Iran would provide reporters with more details on the nuclear issue.

    On November 5, 2019, President Hassan Rouhani said that he instructed the AEOI to implement the fourth stage of moving away from Iranian commitments to the nuclear accord. He said that like the previous stages of Iranian violations of the nuclear agreement, these steps are “reversible,” and if the other nations that also signed the deal will fulfill their side of the agreement and restore Iran to their previous position (January 2017), then Iran will return to fulfill their commitments. Rouhani noted that the IAEA would be allowed to monitor their activities.

    The Iranian president said that the facility in Fordow currently has 1,044 centrifuges in which uranium gas will be injected, in direct violation of the nuclear accord, where it was agreed that the centrifuges would be operated in a vacuum without being injected with gas. Under the agreement, Iran also pledged to drastically reduce the number of centrifuges at the Fordow enrichment site and banned uranium enrichment by 2031. At the same time, Rouhani made it clear that Iran continues to be committed to behind the scenes negotiations with several countries to resolve the crisis. Rouhani claims that Iran “had hoped to achieve results before taking these current measures, but that didn’t happen; No results were achieved, so we had to take this fourth step.”
    IAEA accuses Iran of evading attempts to probe uranium production – report
    The top inspector for the UN’s nuclear agency has reportedly accused Iran of evading attempts to gather information on Tehran’s uranium production at a warehouse that was flagged by Israel and where particles were found earlier this year.

    Bloomberg, in a report Thursday, cited two officials as saying that Massimo Aparo told diplomats in a closed-door meeting in Vienna on Wednesday that the Islamic Republic was “evading attempts to discover the source of manmade and natural uranium particles detected at a warehouse in Tehran.”

    The extraordinary meeting of the International Atomic Energy Agency’s board of governors was convened by Cornel Feruta, the organization’s acting head, to discuss the latest concerns about Iran’s nuclear program, the report said.

    In September, Reuters reported that traces of uranium were found at a facility in Tehran that was alleged by Prime Minister Benjamin Netanyahu to be a “secret atomic warehouse.”

    Iran has not provided an explanation for why uranium was found at the site to the IAEA, which is investigating the facility in the Iranian capital, the news agency reported at the time.
    Top Iranian Official Targeted by New US Sanctions Is Wanted by Argentina for 1994 Bombing of AMIA Jewish Center
    One of the nine top Iranian officials targeted by new US sanctions on Monday is wanted by the Argentine authorities for his alleged involvement in the 1994 terrorist bombing of the AMIA Jewish center in downtown Buenos Aires.

    Ali Akbar Velayati was among the list of senior aides to the Tehran regime’s so-called “supreme leader,” Ayatollah Ali Khamenei, sanctioned by the US Treasury Department’s Office of Foreign Assets Control (OFAC) in order to “block funds from flowing to a shadow network of Khamenei’s military and foreign affairs advisors who have for decades oppressed the Iranian people, exported terrorism, and advanced destabilizing policies around the world,” an OFAC statement said.

    Velayati was Iran’s foreign minister at the time of the AMIA atrocity on July 18, 1994, when 85 people died and hundreds more were wounded when a van packed with explosives was driven into the Jewish organization’s main building in the Argentine capital. He was also alleged to have been present at a meeting of Iranian security officials in the city of Mashhad on Aug. 14, 1993, where the decision to bomb the AMIA building is understood to have been taken.

    In July 2018, Argentine Judge Rodolfo Canicoba Corral requested Velayati’s arrest by Russian authorities while he was on an official visit to Moscow. Velayati met with Russian President Vladimir Putin one day after Corral’s request was issued.

    Judge Corral originally issued international arrest warrants in 2006 for Velayati and seven other Iranian and Lebanese operatives wanted in connection with the AMIA bombing. Corral also tried unsuccessfully to secure Velayati’s arrest under the same warrant in 2016, when the Iranian visited Singapore and Malaysia.


    Mike Pompeo: Iran positioning itself for rapid nuclear break-out
    Iran has positioned itself to rapidly break out into a nuclear power by resuming uranium enrichment at Fordow, US Secretary of State Mike Pompeo said on Thursday.

    “Iran’s expansion of proliferation-sensitive activities raises concerns that Iran is positioning itself to have the option of a rapid nuclear breakout,” Pompeo said.

    The biggest obstacle to build a nuclear weapon is stockpiling enough fissile material — highly enriched uranium or plutonium — for the core of a bomb. A central objective of the 2015 deal was to extend the time Iran would need to do that, if it chose to, to a year from about 2 to 3 months.

    Tehran’s latest "nuclear escalations" reflect the regime’s intentions all along: to extort the international community into accepting its violence and terror while it undermines the sovereignty of its neighbors. Members of the international community who are rightly concerned with Iran’s latest attacks and provocations should imagine how Iran,” Pompeo said.

    He called on the international community to supports sanctions against Iran.
    MEMRI: Even As UK, France Acknowledge That Iran Is Violating The JCPOA, The Trump Administration, After Ostensibly Withdrawing From It, Continues To Preserve It – By Means Of Its Waivers For Civilian Nuclear Cooperation With Iran
    On November 5, 2019, Iran announced that it was taking its fourth step to cut back on its obligations under the JCPOA nuclear agreement. This step includes reviving uranium enrichment at the Fordo nuclear facility and activating an array of advanced centrifuges that will enable it in future to double and triple its enrichment capability. In effect, Iran is systematically stripping the JCPOA of all meaning, ostensibly with the approval of the International Atomic Energy Agency (IAEA).

    France and Britain have issued a public response to this fourth step by Iran, saying for the first time that it is violating the JCPOA.[1]

    Although the U.S., in May 2018, announced its withdrawal from the JCPOA,[2] it is in effect preserving it by continuing to grant significant waivers to the U.S. sanctions. These waivers allow some countries to help Iran develop its nuclear program under the heading of development for civilian needs – allowing Europe, Russia, and China to continue to uphold the agreement (see for example July 2019 statements on this matter by then-U.S. National Security Advisor John Bolton on the continuation of the waivers[3]).

    This report will set out the significance of this fourth step in Iran's withdrawal from its obligations under the JCPOA, as explained by two top regime officials, and will discuss the ramifications of the third step – the cancellation of the JCPOA's research and development timetable for it – for the development of Iran's nuclear program. These ramifications were previously discussed in a MEMRI report published in October.[4]

    Liberty Global results fall in Q3 as west Europe operations lose customers

    (Telecompaper) Liberty Global reported a fall in revenues and operating cash flow from continuing operations in the third quarter, due mainly to continued weakness in Switzerland. Revenues fell 0.6 percent on an organic basis to USD 2.84 billion, also hurt by lower sales at Telenet in Belgium, and OCF excluding forex effects declined 4.1 percent to USD 1.21 billion.

    The Last Harvest: Martinstag, the Räbeliechtliumzug, and Thanksgiving

    We went out the door, wrapped in coats and scarves, with our paper lanterns lit. The streets were dark, but ahead of us, we could make out the shadows of other children and their parents, their faces softly illuminated by their own lanterns hung on sticks. The lanterns swayed gently as we walked. We went up the street, up the long hill, through the little Bavarian town we were temporarily calling home. It was the eve of Martinstag, November 10, and our neighbors who lived in the flat below ours had invited us to come along.

    It wasn't a solemn ritual. There was laughter and chatter, an air of excitement. On the main street, a crowd gathered on either side, the lanterns brightening the darkness. A parade advanced and thundered down the street, roaring with music, vehicles decorated like ships, horses, and other modes of travel. Costumed celebrants called out, "Halloo!" a traditional battle cry, and tossed out candy that we scrambled for and stuffed into sacks.

    At its roots, Martinstag is a holiday of thanksgiving, celebrating the last harvest before winter's advance. It feels something like a less-spooky Halloween or a less-raucous Carnival. Though Christianized, it's a holiday with ancient roots, celebrated throughout much of Europe.

    Other elements of Martinstag are bonfires, festive meals with goose as the main course, the singing of Martin songs, and drinking wine. Wine and geese are ready for harvesting at this time, so they are natural elements of the feast day. Catholic folklore has knitted St. Martin to them: once, St. Martin was being pursued by church officials, who were trying to ordain him as bishop. He hid from them in a goose pen, and the geese gave him away with their cackling. He is also credited with the spread of viticulture in the Touraine region -- especially the cultivation of my favorite white varietal, Chenin Blanc.

    In neighboring Switzerland, the Räbeliechtliumzug (the "raven light parade") occurs at the same time. Switzerland is a culturally diverse country, with strong, enduring connections to their various Celtic, Germanic, and Italian roots. The Celtic influence remains strong even in the eastern German Swiss cantons from which some of my ancestors (on my dad's paternal side) immigrated. While southern Germans use paper lanterns, the German Swiss carve turnips with images of the sun, moon, and stars, and illuminate them. This is tellingly similar to the British and Irish tradition of carving faces onto turnips for Samhain and Halloween. Pumpkins, being native to North America, became the vessels of choice much later.

    A Swiss site states that "the origin of the Räbenlichter [raven lights] is found in the faith of the Celts and Romans, who drove away the spirits of the dead during the dark season." Light has long been used to deter chthonic spirits that might bring illness and death to the living -- both practically (as both fire and sunlight are microbe-destroying purifiers) and symbolically (warding against the uncertainty of the night and the grave, both marked by darkness that hinders sight-dependent humans). This is probably also the reason for the bonfires and paper lanterns in southern Germany, and overall the ancient source of these holidays (along with the expression of gratitude for a bountiful growing season).

    While not generally well known in the U.S., Martinstag is celebrated in Waldorf schools (which have a German heritage, being founded in Stuttgart), where they hold lantern parades while singing Martinstag songs. One of these songs is called "Wild Geese":

    High and blue the sky

    trees are very tall

    wild geese flying seem so small

    see on silent wings in flocks they go
    never parting from a single row

    brothers in one flight are we

     

    clear and dark the night

    stars are very bright

    This song and other Martin songs bring to life, for me, the old feelings and roots of the holiday that has persisted through adaptation. Geese and other water birds are strongly associated with goddesses of water, healing, and fertility across the world. Their flight from northern climes is a symbol of the end of the fertile season; it's almost as if the flocks bear it away with them, leaving the land cold and dormant, in a state of near-death. The lanterns, then, are a message of hope and faith in times of want and struggle -- relevant among all peoples -- as well as a commitment to tend the smaller flames (the candle, the bonfire, the hearth fire, the living inner flame within each person and in each vital community) until the greater flame of the sun draws near again, waking the world from its months-long sleep.

     

    While another name for Martinstag is Old Halloween, there is much about Martinstag that reminds me of American Thanksgiving. In many ways, they are sister holidays, and the elder provides a context for the American holiday that otherwise seems disconnected from the other harvest holidays of our ancestors. We, too, have a parade -- a national one broadcasted every Thanksgiving morning from New York City. Instead of goose, we eat turkey -- a native bird that is likewise hunted in late fall. While not necessarily a widespread tradition, many also drink wine, including mulled wine (called Glühwein in Germany), during Thanksgiving dinner. I'm not aware of any Thanksgiving songs or bonfires, but they would certainly be appropriate and could be easily incorporated into extant traditions. Martin songs like the one above could take their place here or be referred to for inspiration.

     

    I think there's value in paganizing (or repaganizing) the holidays already built into our cultures. Whether or not they have proven ancient pagan origins, and no matter how much they may have been lacquered by Christianity, they still have cores that are relevant to modern pagans and animists -- ties to the seasons, spirits of nature and the household, and our ancestors -- that are meaningful to us and worth honoring. The oldest traditions have survived by evolution during changing times -- why not turn the wheel again toward our own faiths?

    Meredith and her family founded the Mighty Meredith Project - an organization established to raise awareness of Traumatic Brain Injuries (TBI) and the impact of having a hidden illness/disease, with the message of kindness as the beacon of the organization. Meredith hit her head in December 2015. After months of attempting to recover from an initial diagnosis of a concussion, it was also determined Meredith had a blood clot in her brain, due to the head trauma. The associated head trauma has required Meredith to no longer participate in many of the activities she came to love and has changed her outlook on life. The Mighty Meredith Project was created after Meredith settled into a new life of living with traumatic brain injury.

    Combined with the kindness of the community, outpouring of support during a difficult time and the need for Meredith to re-define her “normal”, Meredith wanted to start an organization to help others who may be caught in a similar situation. Her mission is simple:

Adopt-an-Alp supports the transhumance movement, the move of people and animals in accordance with the seasons, a centuries old tradition.

    The UK’s largest food services provider and fourth biggest coffee retailer in the UK, Compass Group UK & Ireland has held its inaugural Barista Championships, which saw four finalists from across the Compass portfolio take part in a highly competitive championship final. The competition was designed to mirror the ‘World Barista Championships’ set-up, to prepare Compass baristas to compete nationally. Razvan Cojocaru, from Restaurant Associates, was crowned winner following two intense rounds, where he demonstrated strong technical ability as well as complex coffee knowledge in his skill, with strong professionalism throughout. Razvan used a coffee from Costa Rica Cordillera Del Fuego which was processed using an anaerobic fermentation method and roasted by the team at Roastworks coffee. Razvan explained that the coffee was like “liquid apple pie”. Competitors: Pariwartan Nepal, from Eurest, Thales Pona, from Restaurant Associates, Arthur Luccats, from Compass Ireland and Razvan Cojocaru seized the opportunity to demonstrate their skills. The competition focused on three key areas: Espresso, milk and a signature drink. All baristas were judged against SCA competition guidelines, using their rules, regulations and score sheets. The final took place at Compass’ SCA accredited premier training campus at the company’s Chertsey HQ, complete with an esteemed panel of judges flown in from Italy and Switzerland as well as the UK. The judging panel consisted of Robert Ward, Cimbali – Technical Judge, Lauro Fioretti, Simonelli Group and Andre Eiermann, UCC – Sensory Judges. Having competed and judged at UK and World Championships themselves, the panel of judges were best placed to survey and assess Compass’s baristas skills. In addition, Compass Coffee Education and Training Manager, Sonali Tailor oversaw the judging team as head judge. The winner received a trip of a lifetime to an Origin’s coffee farm in Costa Rica. Razvan will get to see first-hand where the humble coffee bean starts its journey, as well as the social community projects at origin. Steve Lovegrove, Head of Business Excellence, Compass Group UK & Ireland, said, “The standard and quality of the baristas competing has been exceptional, congratulations goes out to each and every one of the competitors who have put so much into this competition.     A meeting between US President Donald Trump and Chinese President Xi Jinping to sign a long-awaited interim trade deal could be delayed until December as discussions continue over terms and venue, a senior official of the Trump administration told Reuters on Wednesday. The official, who spoke on condition of anonymity, said it was still possible the “phase one” agreement aimed at ending a damaging trade war would not be reached, but a deal was more likely than not. Dozens of venues have been suggested for the meeting, which had originally been scheduled to take place on the sidelines of a now-canceled mid-November summit of Asia-Pacific leaders in Chile, the official said. One possible location is London, where the two leaders could meet after a NATO summit that Trump is due to attend from Dec. 3-4, the official said. “It’s under consideration but nothing decided,” the official said. Other sites are possible in Europe and Asia, but the former is more likely, with Sweden and Switzerland among the possibilities. Iowa, which Trump has suggested, appeared to have been ruled out, the official said. China’s latest push for more tariff rollbacks would be discussed, but was not expected to derail progress toward an interim deal. The official said China was believed to see a quick deal as its best chance for favorable terms, given pressure Trump is facing from a congressional impeachment inquiry as he seeks re-election in 2020. US Treasury prices gained on Wednesday on word that the talks could be delayed, while some investors also repositioned after a three-day sell-off.     "They can be really difficult to administer and ensure even a moderate compliance rate," Daniel Bunn, the director of Global Projects at the nonpartisan Tax Foundation, told Business Insider of the European wealth tax experience.

    He added that it became difficult for governments to justify the high administrative cost of enforcement as the rich were able to move assets and capital out of the country into lower-taxed jurisdictions, often within Europe.

    Instead, Bunn said, European countries did away with it and doubled down on enforcing income taxes among others.

    Spain first introduced a wealth tax (otherwise known as Patrimonio) in 1977, two years after the death of its authoritarian leader Francisco Franco. 

    It kept the tax until 2008 when the global financial crisis threw the Spanish economy into a tailspin. The tax was temporarily reinstated three years later in 2011 to boost public finances, but the national government later decided to make it permanent again. 

    Spain now taxes fortunes above €700,000 at 0.2%, which gradually increases to 2.5% on net worth above €10.7 million depending on the region. People living in the Spanish capital of Madrid are exempt from the tax.

    Its never been a substantial generator of tax money for the Spanish government. Data from the OECD shows that a net wealth tax on individuals made up 0.55 percent of all tax revenues in 2017.



    Norway collects a wealth tax both at the municipal and the national level, starting at 1.48 million krone, or $174,000.

    Norway's wealth tax was first introduced in 1892. The central government levies a tax rate of 0.15% while municipalities impose a 0.7% rate, bringing the maximum to 0.85%.

    Only wealth above 1.48 million krona, or roughly $174,000, is taxed. That figure is doubled for married couples.

    A 2012 study from Norwegian researchers reported that average wealth per household totaled 1.6 million krona, or just over $166,000, indicating that most of the population paid some form of the tax.

    The amount of revenue generated has largely been the same over the last two decades. The OECD reported the wealth tax constituted 1.1% of all Norwegian tax revenue in 2017.



    Switzerland first implemented its wealth tax in 1840. The rate varies by canton, or state, as the central government does not collect the tax.

    The tax-free threshold for a married couple without children is between 50,000 Swiss francs ($50,370) to 250,000 Swiss francs ($251,856). "The wealth tax thus affects much of the middle class in addition to the wealthiest families," one study on the Swiss wealth tax found.

    Compared to the other three European countries, the Swiss wealth tax has generated consistent revenue so far in the 21st century and it brought the largest share. OECD data shows that wealth taxes made up 3.6% of all Swiss tax revenue in 2017, and it's been above 3% since 2000.



    Belgium enacted a limited wealth tax last year on securities accounts containing over €500,000.

    The Belgian government enacted a 0.15% tax on the securities accounts of individuals with holdings over €500,000, or $553,000.
