· School districts across the country — transitioning to online classes as coronavirus shutdowns keep students at home — promoted the offer at Charter's behest.
· But families told Business Insider that they learned they were ineligible for the offer, either because they already have active Spectrum accounts or had outstanding bills on old Spectrum accounts.

When Charter announced last month that it would provide 60 days of free Spectrum internet to families with K-12 students, Maria Castillo was relieved.

The Queens mom had just been furloughed from her retail job, and her son's third-grade class was moving to online learning as schools closed due to the coronavirus outbreak. His school provided a laptop, but Castillo couldn't afford home WiFi, and other bills were piling up without a clear source of income.

Castillo called Spectrum and spent hours on hold — but when she finally reached a representative, she was told she was ineligible for the free internet because she owed Spectrum $285 from 2015.

"Obviously paying that isn't an option for me right now," Castillo told Business Insider. "I don't know what I'm going to do at this point."

Last month, Chalkbeat New York's Reema Amin reported that Optimum and Spectrum — which both announced free internet promotions for students — were turning away New York City families with outstanding bills. Following Amin's reporting, Optimum changed course to waive the rule banning families with outstanding bills. Spectrum has not changed its policy.

Parents and teachers across the US told Business Insider that they were blocked from Spectrum's free internet offer due to outstanding bills or because they're already Spectrum customers, including in areas where Spectrum is the only broadband internet provider.

A Charter spokesperson confirmed in a statement to Business Insider that the company's offer of free Spectrum internet does not apply to existing customers — including those with outstanding balances on old bills.

-Students left in the dark-

Collin Eckburg, a first grade teacher in Madison, Wisconsin, told Business Insider that her elementary school — which serves several low-income neighborhoods — touted Spectrum's offer to students and families after it was announced. Soon, she started getting calls from parents saying they were not eligible due to outstanding bills.

Eckburg called Spectrum on the parents' behalf and was told the same thing. Eckburg's class has already begun online learning using Google Classroom, but she estimates that roughly one-third of her students have been unable to get WiFi at home.

For many families, most of which live within a mile of the school, Spectrum is the only broadband internet provider in the area.

"I'm calling Spectrum and the message when you're on hold is like, 'Connecting you when it matters most.' That's what really sent me over the edge," Eckburg said. "These parents are really trying to be proactive and set up internet for their kids, but the reality is looking like not everybody is going to be connected ... What outcomes will that have for students and their academic success for years to come?"

Jaclyn Kelley, a mom in Jewett, Ohio, said she and her husband recently cancelled their Charter cable subscription because it was no longer affordable. Finances are tight for Kelley, who is "very pregnant" and not working at the moment, but she needs to maintain internet service to keep in touch with her husband while he's at work and for her daughter's elementary school classes, which moved online last month.

She saw Charter's announcement last month that it was offering 60 days of free Spectrum internet promotion "to ease the strain in this challenging time." But when she called Spectrum, Kelley was told that the offer was not available to existing customers.

"There's absolutely no other providers where I am and barley any service," Kelley told Business Insider.

Even for people who aren't already Spectrum customers, the 60-day free internet offer requires that new users sign up with a method of payment that will be billed once the 60-day period ends. That alone has discouraged some financially insecure families from signing up, Eckburg, the teacher in Wisconsin, said.

"They're a business too, and I get that — it's not just a generosity thing," Eckburg said. "The bottom line is, now
certain populations of students are getting access to new learning and new curriculum, and others aren't."

Judge grants Iowa inmate's request for DNA test in 1976 case

FORT MADISON, Iowa (AP) — A judge has ordered DNA testing on a hat left at the scene of a fatal 1976 shooting that an Iowa inmate hopes will prove he has been wrongly imprisoned for decades.

Judge John Wright ordered the orange hunting cap shipped to a Virginia laboratory for testing that could show whether Gentric Hicks or someone else was responsible for the killing at a Fort Madison motel.

Scientists will seek to extract genetic material from inside the cap to create a DNA profile that could be compared to Hicks. Results from the Bode Cellmark laboratory could be available in coming months.

Iowa has never had an inmate exonerated by DNA evidence.

Hicks, 73, is serving life for the May 1976 slaying of 28-year-old Jerry Foster at the Hill Crest Motel, which was owned by Foster's parents.

A man robbing the motel shot and killed Foster and fled on foot, leaving behind the cap.

An accomplice initially implicated Hicks' half brother as the shooter. Hours later, the man changed his story and said Hicks was responsible.

The Midwest Innocence Project and the state's wrongful conviction unit are representing Hicks, who is an inmate at the Anamosa State Penitentiary. Lee County prosecutors didn't oppose their request for DNA testing.


          

Teen arrested in fatal shooting of Wisconsin doctor, husband

MADISON, Wis. (AP) — A University of Wisconsin physician and her husband whose bodies were found at the school's arboretum near the Madison campus were shot to death, and a second teenage suspect in the killings has been arrested, police said.

Police said Saturday that they arrested Ali’jah Larrue, 18, on Friday night. Larrue was booked into jail on two counts of party to the crime of first-degree intentional homicide.

UW police spokesman Marc Lovicott said Sunday that Larrue is an acquaintance of the other suspect, Khari Sanford, 18, who was arrested earlier Friday and booked on the same charges.

“We are confident these are the two guys,” Lovicott told The Associated Press, although the investigation remained active.

A jogger found the bodies of Dr. Beth Potter, 52, and her husband, Robin Carre, 57, last Tuesday, in a ditch at the university’s arboretum, a research and popular recreational area.

Lovicott said the couple had been shot at the arboretum sometime overnight before their bodies were found, but that police were not ready to discuss a motive.

Police have said the couple was targeted and that Sanford was known to the victims' family.

The suspects have not been formally charged but are expected to make their initial court appearances early this week, Lovicott said. He did not know if they have attorneys who could speak on their behalf.

Authorities were led to the suspects through “really good police work and help from our community,” Lovicott said. He said people got in touch with police and shared information.

“That definitely played a part,” Lovicott said.

Potter worked at the Wingra Family Medical Center, run by the UW-Madison Department of Family Medicine and Community Health and Access Community Health Centers. She also was medical director of UW Health’s Employee Health Services.

Carre headed up a Madison youth soccer club. Carre’s professional consulting work involved helping high school students best prepare themselves for college admissions.

The couple is survived by three children in their teens and twenties.

Proposition 2 in East Hampton

The East Hampton School Board has agreed to add a second proposition to the school budget ballot asking for voter approval to spend $2.2 million from a capital reserve account for a commercial kitchen at East Hampton High School. During a virtual meeting on April 1, board members pointed out that the measure would not increase taxes because the district already has the money set aside.

The new kitchen would be the site of an in-house culinary arts and hospitality program, eliminating the need to spend money on tuition and busing for high school students taking that program through the Eastern Suffolk Board of Cooperative Educational Services. “This is something that the community wants,” said J.P. Foster, the school board president. “We’re bringing it to the next level.”

The proposition will appear on the ballet below the school budget. The vote and board elections have been moved from May to June by executive order of Gov. Andrew M. Cuomo as part of the response to the Covid-19 pandemic.

New Assistant for Business

The East Hampton School Board also voted on April 1 to hire a new assistant superintendent for business. Keith Rugen will start in his new post on July 1. The previous business official resigned in October of 2019, and Isabel Madison, who served in that capacity for many years at East Hampton, returned from retirement for several months until a permanent successor could be found. Mr. Rugen has been an intern and consultant for the Amityville and Hampton Bays school districts.

According to Richard Burns, the district superintendent, Ms. Madison will conclude her service sometime after Mr. Rugen starts, allowing him to get acclimated. “His primary work experience is in the banking world as a senior financial professional,” Mr. Burns said.

Spring Break Goes Away

School districts that had not already moved up their spring recess, which would have been this week, have had those vacation days canceled by Governor Cuomo. South Fork districts affected by the decision include Amagansett, Bridgehampton, and Sag Harbor.

“I am aware that many students and staff were looking forward to spring break. . . . However, I am also aware that some students benefit from the structure of the lessons provided by our teachers,” Seth Turner, the Amagansett superintendent, said in a letter to the community. “During these trying times, the continuity of instruction can potentially help to reduce anxieties among children.” He also encouraged families to “feel free to relax.”

In Sag Harbor, the school board has signed an agreement with its teachers to give them one personal day in exchange for each day worked during what would have been spring break.

State Mental Health Funding 

In New York State’s recently released budget, legislators included $175,000 to continue the South Fork Behavioral Health Initiative, which is a partnership among the state, Stony Brook Southampton Hospital, the Family Service League, and local governments and schools to expand access to mental health services for youth. Assemblyman Fred W. Thiele Jr. said in a statement that the program has led to fewer referrals to the comprehensive psychiatric emergency program at the main campus of Stony Brook University Hospital.

“We still have a long way to go to provide the full range of help and services needed on the South Fork to treat mental illness,” Mr. Thiele said. “This program has shown tremendous success toward meeting the mental health needs that exist in our community.”

Knotel is scrambling to pay millions in bills that started stacking up before the coronavirus hit, and hasn't paid April rent at some locations

The flexible-office provider Knotel's heavy cost-cutting measures extend well beyond last month's 50% staff cut.

The New York-based company has stopped paying some rent and vendors — and it has a backlog of payments that predates the coronavirus by many months, a Business Insider investigation, which included talking to nine current and former employees and Knotel business partners, found. 

Financial data reviewed by Business Insider showed Knotel had substantially missed sales targets as recently as the fourth quarter of 2019 and accrued hundreds of thousands of square feet of vacant space months before the economic crisis touched off by the coronavirus began.  

That may make it especially vulnerable to the downturn sweeping across the flexible-workspace industry.

Until recently, Knotel was one of the fastest-growing brands in the booming coworking and flexible-space field, emerging as a chief competitor to WeWork.

COVID-19 has upended the soaring sector as small businesses, startups, and entrepreneurs that flooded into flexible workspaces in recent years have shed those locations or stopped paying rent, leaving companies such as Knotel with less cash flow to pay landlords.

Several sources with direct knowledge of Knotel's 2.5 million square feet of space in New York said the company hasn't paid rent for the month of April at several locations, including spaces at 40 Exchange Place, 5-9 Union Square West, and 61 Broadway. The sources said it was still possible the company could avoid missing the payments by settling the outstanding rent bills before the close of the month.

The cutoff of money could be painful for landlords. The Moinian Group, a large Manhattan property owner, for instance, is both an investor in Knotel and one of its largest landlords, hosting Knotel locations at several of its office buildings, including 545 Fifth Ave., 60 Madison Ave., and 90 John St.

The landlord's chief executive, Joseph Moinian, declined to comment on whether he stood to lose money from his investment into Knotel's business and whether the company was still paying rent at locations within Moinian's portfolio.

Flex-space providers are looking to cut costs as space sits empty

Knotel is one of several major workspace brands that have sought to cease hemorrhaging money by cutting back — or abandoning — their rent obligations. 

Convene, a workspace and conference company, is also cutting the rent payments it makes to landlords across its portfolio, according to an investor in the company.

"Convene is working with all landlords individually and on a case-by-case basis," a spokesman for Convene said.

And WeWork has sought to renegotiate leases in its over 7 million-square-foot portfolio in New York to reduce its rent burden, according to the Financial Times and other media reports. 

Businesses of all kinds have sought to hold back commercial rents as social-distancing rules have prevented many from occupying their office space. Landlords, which are prohibited by a New York state moratorium from evicting both residential and commercial tenants, have urged office occupants to continue to pay rent.

But because of the widespread economic dislocation from the crisis, many owners are expected to be flexible with late or discounted payments and not pursue wide-scale evictions.

"Given the unprecedented times we are witnessing due to the effects of Covid-19, the Knotel team is focused on balancing the interests of customers, partners, and investors, in efforts to build a sustainable, long-term business," Ivy Chiou, a spokeswoman for Knotel, said in a statement. "We are taking these steps to ensure we are well-positioned for both current times of great crisis, as well as when business returns to a new normal."

Chiou said the company would not confirm whether it had suspended rent payments, nor whether it was current on its rent in any specific locations.

Knotel struggled to hit its targets well before the coronavirus hit, its internal financial reporting, which was viewed by Business Insider, showed.

Knotel has said publicly that it had $350 million in annual revenue lined up at the start of 2020. According to internal documents seen by Business Insider, the company had $335 million in annual revenue signed on near the end of the fourth quarter of 2019, $80 million short of its $422 million forecast.

In New York, Knotel signed just $5.8 million in net new contracts in the fourth quarter, compared with a goal of $51.5 million.

Across the 15 cities globally where the company operates, it added about $50 million of new revenue in the quarter, $50 million short of its target. 

Flex-office companies generally saw a slowdown in leasing activity in the fourth quarter, according to CBRE data. Much of that industrywide decline was driven by WeWork, though Knotel's drop in leasing — 70,000 square feet of new deals in the fourth quarter, a decline of 80% from its quarterly activity over the previous year — was much more precipitous than its competitor Industrious, which was down 6.5%.

The leaked financial documents also showed that Knotel had about 500,000 square feet of vacancy in its portfolio in December, a number that is projected to grow to 1.5 million square feet as it takes possession of additional spaces it has committed to lease.  

Hundreds of thousands owed to brokerages

One current Knotel employee said the company's legal and finance teams were "combing through the leases to see where we can stop paying rent" so that the company could fund its payroll. 

The source, who spoke on condition of anonymity because they were not authorized to speak with the media, said Knotel considered payments to vendors, general contractors, and brokers its last priority, with those payments likely to be deferred for three to six months or longer. The source also said Knotel was evaluating the possibility of extracting itself from spaces by encouraging landlords and the occupants of its spaces to strike deals directly, with Knotel no longer serving as the middleman.

"Knotel would get out of an unfavorable real-estate deal, the landlord would get a paying client, and the tenant would remain in the space, however, without Knotel's workspace management operations," the source said. 

Knotel has also fallen behind on commission payments to major brokerage firms that have arranged leases for occupants to take space in Knotel's portfolio. According to two sources with direct knowledge of the agreements, CBRE and Cushman & Wakefield, two of the largest commercial-real-estate brokerage companies, are each owed hundreds of thousands of dollars. CBRE and Cushman & Wakefield declined to comment on the commission payments. Knotel's spokeswoman declined to comment.

Another brokerage firm, SquareFoot, is also owed a commission, two sources with direct knowledge of that debt said. One source described the commission as a five-figure sum.

Stiffing brokerage companies could dissuade those firms from bringing Knotel tenants in the future, which could deal a blow to its future growth plans in the city. 

A former Knotel employee, who spoke with Business Insider on the condition of anonymity, said the company had unpaid bills that total in the millions of dollars. The former employee based that information on vendor negotiations in which they were directly involved. Knotel's spokeswoman declined to comment on outstanding bills.

One vendor, for example, was owed $500,000 — and their unpaid bill dated from at least summer, this source, who left earlier this year, said.

Once, a Knotel employee accidentally copied a number of vendors on an email about vendors Knotel planned not to pay. In most instances while the source worked at Knotel, vendors were eventually paid, at least in part. 

"Most of them at least got paid at least some of what they were owed. That was enough to keep them at bay, and our finance team was keeping track of how frustrated everyone was at them," this source said. 

Knotel's chief financial officer, John Jureller, who was hired into the position in March, wrote in a recent internal email, which was viewed by Business Insider, that the company was looking at payments to vendors and landlords to try to stabilize its deteriorating financial position.

"At this time, we are completely clamping down on any and all payments other than our obligations to employees and our contractors / temps," Jureller's email said. "Together with legal, we are carefully analyzing the impacts to landlords, vendors and other statutory payments."

In a dramatic cost-cutting measure last month, Knotel laid off or furloughed half of its 400-person staff. CEO Amol Sarva, a tech entrepreneur who cofounded Knotel five years ago and pushed the business aggressively to compete alongside WeWork, continued to strike a cheerful tone on his LinkedIn page despite the company's recent setbacks.

"Knotel is hiring," his page says. "Join us."

Business Insider previously reported that Sarva had sent a companywide email laying out Knotel's plans to bury upcoming staff reductions by running a positive news story about real estate's role in helping the community during the coronavirus pandemic.
